SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:
Article 2B - Alcoholic Beverages
19.
(s) In Prince George's County,
(5) In Prince George's County there is in addition to
the classes provided for, a special Class B license known as
Class BLX which is issued only to luxury type restaurants; they
shall be applied for in the regular manner and the license fee is
$1,080. A luxury type restaurant shall be as defined by the
rules and regulations of the board of liquor license
commissioners for Prince George's County, if the restaurant has a
minimum capital investment of [$500,000] $700,000 for dining room
facilities and kitchen equipment, which sum may not include the
cost of land, buildings or a lease, with a minimum seating
capacity of 150 persons. The board of license commissioners has
complete discretion as to whom these licenses shall be issued,
the number to be issued, and as to whether an existing license
holder of an alcoholic beverage license in Prince George's County
may also have an interest in one Class BLX license. An
individual or corporation may hold not more than 4 Class BLX
licenses. This license is limited and restricted to the purpose
of providing alcoholic beverages for consumption on the licensed
premises only, with no off-sale privileges to be exercised. The
residency requirements specified in § 40 of this article as it
pertains to Prince George's County do not apply to Class BLX
licenses.
SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.
