VETOES
(1) A CASHIER'S BOOTH OR KIOSK THAT IS CONSTRUCTED:
(I)1. ON AN ISLAND; OR
2. AS A BOOTH CUT INTO THE MAIN BUILDING;
(II) WITH BULLET RESISTANT GLASS, BULLET
RESISTANT METAL DOORS, AND BULLET RESISTANT BRICK OR CINDERBLOCK,
WITH STANCHIONS TO GUARD AGAINST COLLISION FROM VEHICLES;
(III) WITH DOORS EQUIPPED WITH HEAVY DUTY BOLTS
AND OPERATOR-CONTROLLED LOCKS; AND
(IV) WITH A RESTROOM FACILITY AVAILABLE IN THE
BOOTH OR KIOSK;
(2) WITH PROVISIONS FOR A TELEPHONE;
(3) (2) A SECURITY CASH DRAWER OR CAROUSEL;
(4) (3) ADEQUATE AREA LIGHTS;
(5) (4) REMOTE-CONTROLLED PRE-PAID CAPABILITY PUMPS;
AND
(6) (5) SECURITY SAFES OR DROP BOXES IN WHICH TO
DEPOSIT EXCESSIVE MONEY.
(E) (1) SUBSECTION (D) OF THIS SECTION DOES NOT APPLY TO
ANY DEALER WHO OPERATES A CONVENIENCE STORE AT ITS MARKETING
LOCATION UNDER A FRANCHISE OR OTHER SIMILAR AGREEMENT WHERE THE
FRANCHISE OR OTHER AGREEMENT IS WITH A PARTY OTHER THAN THE
DISTRIBUTOR TO THE DEALER.
(2) THE SECURITY DEVICES REQUIRED UNDER SUBSECTION
(D) OF THIS SECTION MUST BE INSTALLED WITHOUT CHARGE TO THE
DEALER, EXCEPT THAT THE COST OF THE SECURITY DEVICES MAY BE ADDED
TO THE DISTRIBUTOR'S CAPITAL INVESTMENT BASE FOR THE PURPOSE OF
DETERMINING RENTS.
(E) (F) A DISTRIBUTOR MAY REQUIRE A DEALER TO KEEP A RETAIL
OUTLET OPEN FOR BUSINESS FOR A SPECIFIED NUMBER OF HOURS PER DAY
OR DAYS PER WEEK ONLY WHEN THE REQUIREMENT IS NEGOTIATED IN GOOD
FAITH BY BOTH PARTIES, ARRIVED AT IN MUTUAL AGREEMENT, AND IS
BASED ON A BONA FIDE BUSINESS NEED OF THE DEALER.
SECTION 3. AND BE IT FURTHER ENACTED, That a distributor
shall be deemed in compliance with this Act if the distributor
has installed the security devices required under this Act at the
retail outlets of dealers with which the distributor has a
marketing agreement in at least the following percentages;
