WILLIAM DONALD SCHAEFER, Governor

[(h)] (I) The Administration and the Maryland State Police
shall establish prevention and education programs to encourage
compliance with the provisions of this section.

[(i)] (J) The Administration shall include information on
this State's experience with the provisions of this section in
the annual evaluation report on the State's highway safety plan
that this State submits to the National Highway Traffic Safety
Administration and the Federal Highway Administration under 23
U.S.C. § 402.

[(j)] (K) A police officer may enforce the provisions of
this section only as a secondary action when the police officer
detains a driver of a motor vehicle for a suspected violation of
another provision of the Code.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.

Dear Mr. President:

In accordance with Article II, Section 17 of the Maryland
Constitution, I have today vetoed Senate Bill 376.

This bill permits wholesale or retail establishments, other
than automobile dealerships, to conduct business on Sunday in
Baltimore City and Anne Arundel, Baltimore, Carroll, Harford, and
Howard Counties.

Senate Bill 322, which was passed by the General Assembly
and signed by me on May 14, 1987, applies to 21 jurisdictions in
the State, including those listed in Senate Bill 376. It has the
same legal effect for those counties named as Senate Bill 376.
However, in addition to losing the near-Statewide uniformity
provided by Senate Bill 322, the fines listed in Senate Bill 376
conflict with the fines listed in Senate Bill 322. For this
reason, Senate Bill 376 will not be signed.
