the WSSC under contract, the property owner shall agree in
writing to hold harmless the WSSC from liability from any and all
damages that may result from or be caused by:

(i) The construction, maintenance, and
operation by the property owner of the floodproofing facility;

(ii) The failure of the floodproofing facility
to operate as planned or designed; or

(iii) The failure of the property owner to
properly maintain and operate the floodproofing facility.

(2) The agreement shall:

(i) Run with the land;

(ii) Be recorded among the land records of the
county in which the land is situated;

(iii) Provide that the property owner accepts
full responsibility and liability for maintenance and operation
of the floodproofing facility on the property at no further cost
or expense to the WSSC.

(d) (1) All WSSC funds expended for floodproofing
facilities under this section shall be a part of the general
storm drainage bonding authority as provided in Title 4 of this
article.

(2) Payment of the bonds shall be in accordance with
§ 3-206(g) of this subtitle.]

3-203.

(A) (1) FOR THE PURPOSE OF PROVIDING FUNDS FOR THE
PLANNING, ACQUISITION, CONSTRUCTION, RECONSTRUCTION,
ESTABLISHMENT, EXTENSION, ENLARGEMENT, DEMOLITION OR PURCHASE OF
FACILITIES (INCLUDING WITHOUT LIMITATION ANY LAND, INTERESTS IN
LAND, OR EQUIPMENT) FOR THE CONTROL AND DISPOSITION OF STORM AND
SURFACE WATERS, INCLUDING FLOODPROOFING, FLOOD CONTROL, OR
NAVIGATION PROGRAMS AND OTHER STORMWATER PROGRAMS AND SYSTEMS,
MONTGOMERY COUNTY AND PRINCE GEORGE'S COUNTY MAY ISSUE BONDS,
FROM TIME TO TIME, IN ANY AMOUNTS AS THEY MAY DEEM NECESSARY TO
PROVIDE FUNDS FOR THEIR RESPECTIVE PORTIONS OF THE STORMWATER
PROGRAMS AND SYSTEMS AUTHORIZED UNDER THE PROVISIONS OF THIS
SUBTITLE.

(2) BONDS ISSUED UNDER THE AUTHORITY OF THIS SECTION:

(I) ARE FULLY REGISTERED (AS TO BOTH PRINCIPAL
AND INTEREST) GENERAL OBLIGATION BONDS OF THE ISSUING COUNTY
APPROVED BY ORDINANCE OR OTHER LEGISLATIVE ACT OF THE COUNTY;
