Ch. 685                                    LAWS OF MARYLAND

WSSC FOR STORMWATER MANAGEMENT AND THE UNDEPRECIATED COST OF THE
MOVEABLE ASSETS TRANSFERRED.

(3) THE TRANSFER OF THIS PROPERTY DOES NOT IMPAIR IN
ANY MANNER THE RIGHTS OF HOLDERS OF BONDS ISSUED BY THE WSSC FOR
STORMWATER MANAGEMENT OR THE RESPONSIBILITY OF THE WSSC FOR THE
REPAYMENT OF THE BONDS OR THE RESPONSIBILITY OF THE COUNTIES TO
LEVY TAXES FOR OR OTHERWISE GUARANTEE THE REPAYMENT OF THE BONDS.

(E)  EACH COUNTY IS RESPONSIBLE FOR THE MAINTENANCE OF
STORMWATER MANAGEMENT SYSTEMS OR PARTS OF THE SYSTEMS LOCATED
WITHIN ITS STORMWATER MANAGEMENT DISTRICT AND TRANSFERRED TO IT
UNDER THIS SECTION.

(F)  THE WSSC AND ANY MUNICIPALITY IN PRINCE GEORGE'S COUNTY
AND MONTGOMERY COUNTY SHALL PERMIT THE COUNTY TO ENTER AND EXIT
OVER ANY OF THE FEES, LEASEHOLDS, EASEMENTS, OR RIGHTS-OF-WAY OF
THE WSSC OR THE MUNICIPALITY TO MAINTAIN ANY STORMWATER
MANAGEMENT EASEMENT, STRUCTURE, OR OTHER PROPERTY.

(a)  (1) If the WSSC determines as part of a general
stormwater management project that incidental floodproofing for
some individual properties is the most sound alternative from
economic, environmental, and engineering points of view to
correct a particular drainage or flooding problem, the WSSC may
expend funds for individual floodproofing facilities on private
property.

(2) The WSSC may expend funds under this section by:

(i) Reimbursing a property owner for the costs
of construction work; or

(ii) Performing the construction work under
contract as part of the general stormwater management project.

(b)  (1) If the WSSC reimburses a property owner for the
costs of construction work, the property owner shall submit
construction plans and a cost estimate to the WSSC for review and
approval before construction begins.

(2) The WSSC shall make payment only after:

(i) The WSSC inspects and approves the
completed floodproofing facility; and

(ii) The property owner submits the original
cost invoice to the WSSC.

(c)  (1) Whether the floodproofing facility is constructed
by the property owner or the agent of the property owner or by
