the violation. In the absence of the owner of the vehicle, the
operator of the vehicle shall be presumed to be responsible for
the violation. Provisions of this subsection do not apply to a
disabled person who obtains a special permit pursuant to the
provisions of § 10-307.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.

AN ACT concerning

Contract Financing Fund - Equipment

FOR the purpose of expanding the permitted uses for certain
loans, loan guarantees, and equity investment guarantees
under the Contract Financing Fund of the Maryland Small
Business Development Financing Authority to include
equipment under certain circumstances; and requiring the
Authority to enter into a security agreement when a loan or
guarantee is for equipment.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Financial Institutions

13-228.

(a) The Authority may utilize the Contract Financing Fund
to guarantee a loan made to an applicant only if:

(1) The applicant meets the qualifications required
by this subtitle;
