Ch. 590                                    LAWS OF MARYLAND.

(H) (1) THE UNIFORM EXPERIENCE RATING PLAN SHALL BE THE
EXCLUSIVE MEANS OF PROVIDING PROSPECTIVE PREMIUM ADJUSTMENT BASED
UPON MEASUREMENT OF THE LOSS PRODUCING CHARACTERISTICS OF AN
INDIVIDUAL INSURED.

(2) AN INSURER MAY FILE A RATING PLAN THAT PROVIDES
FOR RETROSPECTIVE PREMIUM ADJUSTMENTS BASED UPON AN INSURED'S
PAST EXPERIENCE.

244P.

(a)  Insurers shall file with the Commissioner, and the
Commissioner shall review, reasonable rules and plans for
recording and reporting of loss and expense experience in
appropriate form and detail. The Commissioner may designate 1 or
more . rating organizations to assist in gathering such experience
and making compilations thereof. An insurer may not be required
to record or report its experience on a classification basis
inconsistent with its own rating system.

(b)  The Commissioner and every insurer and rating
organization may exchange information and experience data with
insurance regulatory officials, insurers, and rating
organizations in this and other states, and may consult with them
with respect to rate-making and the application of rating
systems.

(C) AN INSURER PROVIDING WORKERS' COMPENSATION INSURANCE
SHALL MAINTAIN REASONABLE RECORDS SHOWING INVESTMENT INCOME

EARNED BY THE INSURER. AN INSURER'S MAINTENANCE OF SUCH

INVESTMENT INCOME RECORDS IN THE OFFICE OF A LICENSED RATING
ORGANIZATION OF WHICH AN INSURER IS A MEMBER OR SUBSCRIBER IS
COMPLIANCE WITH THIS SECTION IF THE INSURER:

(1) MAINTAINS MEMBERSHIP OR SUBSCRIBERSHIP IN THE
RATING ORGANIZATION; AND

(2) USES THE RATES, RATING PLANS, RATING SYSTEMS, OR

UNDERWRITING RULES OF THE RATING ORGANIZATION. RATING

ORGANIZATIONS SHALL COLLECT ALL RELEVANT DATA FROM MEMBER
INSURERS.

(A)  EXCEPT AS PROVIDED IN SUBSECTION (D) OF THIS SECTION,
THE COMMISSIONER SHALL REVIEW EACH WORKERS' COMPENSATION
INSURANCE FILING AS SOON AS REASONABLY POSSIBLE AFTER THE FILING
HAS BEEN MADE IN ORDER TO DETERMINE WHETHER IT MEETS THE
REQUIREMENTS OF THIS SUBTITLE.

(B)  (1) THE EFFECTIVE DATE OF EACH WORKERS' COMPENSATION
INSURANCE FILING SHALL BE THE DATE SPECIFIED IN THE FILING. THE
