WILLIAM DONALD SCHAEFER, Governor Ch. 590

EFFECTIVE DATE OF THE FILING MAY NOT BE EARLIER THAN 30 DAYS
AFTER THE DATE THE FILING IS RECEIVED BY THE COMMISSIONER OR THE
DATE OF RECEIPT OF THE INFORMATION FURNISHED IN SUPPORT OF THE
FILING IF SUCH SUPPORTING INFORMATION IS REQUIRED BY THE
COMMISSIONER.

(2)  THE PERIOD DURING WHICH THE FILING MAY NOT BECOME
EFFECTIVE MAY BE EXTENDED BY THE COMMISSIONER FOR AN ADDITIONAL
PERIOD NOT TO EXCEED 30 DAYS IF THE COMMISSIONER GIVES WRITTEN
NOTICE WITHIN THE PERIOD DESCRIBED IN PARAGRAPH (1) OF THIS
SUBSECTION TO THE INSURER OR RATING ORGANIZATION WHICH MADE THE
FILING THAT THE COMMISSIONER NEEDS ADDITIONAL TIME FOR THE
CONSIDERATION OF THE FILING.

(3)  UPON WRITTEN APPLICATION BY SUCH AN INSURER OR
RATING ORGANIZATION, THE COMMISSIONER MAY AUTHORIZE A FILING,
WHICH THE COMMISSIONER HAS REVIEWED, TO BECOME EFFECTIVE BEFORE
THE EXPIRATION OF THE PERIOD DESCRIBED IN PARAGRAPH (1) OF THIS
SUBSECTION.

(4)  A FILING SHALL BE DEEMED TO MEET THE REQUIREMENTS
OF THIS SUBTITLE UNLESS DISAPPROVED BY THE COMMISSIONER WITHIN
THE PERIOD DESCRIBED IN PARAGRAPH (1) OF THIS SUBSECTION OR ANY
EXTENSION THEREOF.

(C)(1) FILINGS OF WORKERS' COMPENSATION RATES, RATING
PLANS, AND RATING SYSTEMS BY A WORKER'S COMPENSATION RATING
ORGANIZATION SHALL BE LIMITED TO PROVISION FOR CLAIM PAYMENT, AND
MAY NOT INCLUDE ALLOWANCES FOR OR RECOGNITION OF EXPENSES, TAXES,
OR PROFIT.

(2) A WORKERS' COMPENSATION RATING ORGANIZATION

SHALL FILE EACH PROVISION FOR CLAIM PAYMENT, EACH WORKERS'

COMPENSATION POLICY FORM TO BE USED BY ITS MEMBERS OR

SUBSCRIBERS, AND A REPORT OF INVESTMENT INCOME.

(3) THE FILING SHALL BECOME EFFECTIVE, OR BE

DISAPPROVED, UNDER SUBSECTION (B) OF THIS SECTION.

(C) SUBJECT TO APPROVAL OR DISAPPROVAL UNDER SUBSECTION (B)
OF THIS SECTION, A WORKERS' COMPENSATION RATING ORGANIZATION
SHALL FILE WITH THE COMMISSIONER;

(1) WORKERS' COMPENSATION RATES, RATING PLANS, AND
RATING SYSTEMS PLANS THAT ARE LIMITED TO PROVISION FOR CLAIM
PAYMENT;

(2) EACH WORKER'S COMPENSATION POLICY FORM TO BE USED
BY ITS MEMBERS OR SUBSCRIBERS;

(3) THE UNIFORM CLASSIFICATION;

(4) THE UNIFORM EXPERIENCE RATING PLAN AND RULES; AND
