The punctuation, a comma, and the disjunctive
conjunction, "or", were omitted from Ch. 844 of the
Acts of 1976.
The omission of the conjunction was noted by the
Michie Company. The omission of the comma was noted
by the professional staff of the Legislative Division
of the Department of Legislative Reference.
Article 100 - Work, Labor and Employment
76.
(c) The provisions of this section shall not apply to the
law-enforcement personnel of the Maryland Alcohol AND TOBACCO Tax
Enforcement Unit.
(1) An agency may adopt alternate work schedules as
permitted by the Fair Labor Standards Act for the purpose of
determining overtime compensation for its law-enforcement
employees or fire fighters.
(2) A law-enforcement employee of the Maryland State
Police or Natural Resources Police who is called out to duty on a
regularly scheduled off-duty day or during a regularly scheduled
on-duty day after going off duty shall be compensated at one and
one-half times the employee's regular hourly rate. This payment
shall be made for not less than four hours time on any day the
employee is called out. A law-enforcement employee of any other
State agency who is called out to duty on a regularly scheduled
off-duty day shall be compensated at one and one-half times the
employee's regular hourly rate for the time worked.
DRAFTER'S NOTE: This corrects an outdated reference in
Article 100, § 76(c).
The Maryland Alcohol Tax Enforcement Unit under the
Office of the Comptroller officially became the
Maryland Alcohol and Tobacco Tax Enforcement Unit in
Ch. 36 of the Acts of 1978.
The outdated was noted by the professional staff of

(b) The following persons are not subject to this subtitle:
(1) Any person who engages in a farm labor
contracting activity on behalf of a farm, processing
establishment, seed conditioning establishment, cannery, or
packing shed, owned and operated exclusively by that person or an
