WILLIAM DONALD SCHAEFER, Governor                   Ch. 536

County Sheriff's Office; including certain salary rates

pension and fringe benefits in the definition of

compensation for collective bargaining purposes; and
generally relating to collective bargaining for compensation
and pension and fringe benefits for certain employees of the
Prince George's County Sheriff's Office.

BY repealing and reenacting, with amendments,

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Courts and Judicial Proceedings

2-309.

(r)(7)(I) THE TERM "COMPENSATION", AS USED IN

SUBPARAGRAPH (II) OF THIS PARAGRAPH, MEANS A COMPILATION OF
SALARY SCHEDULES, AS RECOMMENDED BY THE PRINCE GEORGE'S COUNTY
EXECUTIVE AND APPROVED BY THE COUNTY COUNCIL PURSUANT TO § 903 OF
THE PRINCE GEORGE'S COUNTY CHARTER THAT:

1. STATES THE COMPENSATION FOR ANNUAL AND
HOURLY RATED EMPLOYEES WHO OCCUPY POSITIONS THAT ARE ESTABLISHED
BY THE PRINCE GEORGE'S COUNTY CLASSIFICATION PLAN; AND

2. INCLUDE THE BASE SALARY RATES OF ALL
THOSE CLASSIFIED AND EXEMPT SERVICE EMPLOYEES AND ANY OTHER
SPECIAL SALARY RATES AND PRINCE BENEFITS.

(II) THE TERM "COMPENSATION" DOES NOT APPLY TO

EMPLOYEES WHO OCCUPY POSITIONS FOR WHICH COMPENSATION IS

ESTABLISHED IN AN APPROVED PRINCE GEORGE'S COUNTY EXECUTIVE PAY

PLAN AND TO ELECTED COUNTY OFFICIALS WHOSE SALARY AND

COMPENSATION IS ESTABLISHED BY THE PRINCE GEORGE'S COUNTY CHARTER
OR BY PROVISIONS OF THE ANNOTATED CODE OF MARYLAND.

(III) (r)(7) All nonprobationary commissioned
full-time employees, including deputy sheriffs of all ranks, are
subject to the Law Enforcement Officers' Bill of Rights. They
are also subject to the labor code of the county with regard to
collective bargaining for compensation [ only. [Compensation
for the purpose of this paragraph is defined in the personnel law
of the county, Section 16-102(53) salary plan, pursuant to
Section 903 of Article IX of the Charter of Prince George's
County.], INCLUDING PENSION AND OTHER FRINGE BENEFITS. The County
