conservation standards under this section would pose a
substantial financial hardship.

(2)  For any waiver granted under this section, the
Department shall issue a written statement that clearly
identifies the building affected and that specifies that the
Department has granted a waiver from the energy conservation
requirements of this section.

(3)  To be effective, a waiver issued for a building
under this subsection shall be filed by the builder in person or
by certified mail (return receipt) with the electric company
designated to provide electric service to the building.

Article - Financial Institutions

(c) "Department" means the Department of [Economic] HOUSING
and Community Development.

13-308.

(b) The Department shall:

(1)  Use the fund to make loans and to pay expenses of
the Program (including reserves for anticipated future losses
directly related to the Program) as provided in the annual budget
of the State or other act appropriating moneys; or

(2)  Transfer moneys from the fund to the Rental
Housing Production Fund under [Section 11-805 of Article 41]
ARTICLE 41B, § 2-505 of the Code as provided in the budget, if
sufficient moneys are maintained in the Program to make loans to
individuals to purchase homes, taking into account the lending
history under the Program, other resources, the number of income
eligible individuals, and the availability of suitable housing
stock.

(b) "Department" means the Department of [Economic] HOUSING
and Community Development.

(f) "Secretary" means the Secretary of [Economic] HOUSING
and Community Development.

(b) "Administration" means the Community Development
Administration of the Department of [Economic] HOUSING and
Community Development.
