WILLIAM DONALD SCHAEFER, Governor                   Ch. 311

(o) "Supplier" means any firm or any part or subsidiary of
any firm which supplies, sells, transfers, or otherwise furnishes
(as by consignment) any State set-aside product to consumers or
wholesale purchaser-resellers.

(p) "Telecommunication services" means the emergency or
essential installation, repair, operation, and maintenance of
voice, data, telegraph, video, and similar communication services
to the public by a communications common carrier.

(q) "Truck" means a motor vehicle with a motive power
designed primarily for the transportation of property or special
purpose equipment and with a gross vehicle weight rating for a
single vehicle (the value specified by a manufacturer as the
loaded weight of the vehicle) or the equivalent thereof in excess
of 20,000 pounds, or in the case of trucks designed primarily for
drawing other vehicles and not so constructed as to carry a load
other than part of the weight rating (the value specified by the
manufacturer as the loaded weight of the combination vehicle) or
the equivalent thereof in excess of 20,000 pounds.

(r) "Vanpool operation"' has the meaning specified in
Section 11-175.1 of the Transportation Article [of the Annotated
Code of Maryland].

(s) "Wholesale purchaser-reseller" means any firm which
purchases, receives through transfer, or otherwise obtains (as by
consignment) a State set-aside product and resells or otherwise
transfers it to other purchasers without substantially changing
its form.

[11-202.] 7-202.

(a)  The Department shall establish and maintain in a state
of readiness, plans and procedures for implementing a State
standby set-aside program for use during an energy emergency.

(b)  The set-aside program shall be established for the
following products: Motor gasoline, middle distillate, propane,
residual fuel oil (except as used in electric generating stations
by electric companies or as bunker fuel for marine shipping), and
aviation gasoline.

(c)  The Secretary shall determine the appropriate State
set-aside percentage level for each product and may review and
revise such percentages as deemed appropriate. Such percentage
levels shall not exceed 5 percent for motor gasoline, 4 percent
for middle distillates, 3 percent for propane, 3 percent for
residual fuel oil (except as used in electric generating stations
by electric companies or as bunker fuel for marine shipping) and
2 percent for aviation gasoline.
