(2)  The matching grants shall be allocated using a
formula to be developed by the Secretary taking into account
population and other relevant factors.

(3)  A political subdivision may charge a property
owner an inspection fee for any inspection in connection with
enforcement of the minimum livability code.

(e) (1) Any property owner who willfully violates any
provision of the housing livability code adopted under subsection
(a) of this section is guilty of a misdemeanor and on conviction
for each violation is subject to a fine not exceeding $500 for
each day that the violation exists or imprisonment not exceeding
3 months, or both.

(2) Any penalty ordered under paragraph (1) of this
subsection is in addition to and is not a substitute for any
other penalty authorized under a federal, State, or local law.

(f) A person may not be displaced by enforcement of the
minimum livability code unless alternate housing is provided.

[11-404. ] 6-104.                                                        

(a)  (1) In this section the following terms have the
meanings indicated.

(2) "ASHRAE" means the organization known as the
American Society of Heating, Refrigerating, and Air Conditioning
Engineers.

(3) "Public Building" means:

(i) Any building that is owned by the State or
any county or municipal government or any agency thereof;

(ii) The provisions of this section shall apply
to all public buildings, as defined, which are 10,000 or more
square feet in area, per floor.

(b)  (1) The Department [of Economic and Community
Development], in conjunction with the Department of Natural
Resources, shall develop guidelines for recommended illumination
levels in existing public buildings in Maryland 6 months after
ASHRAE 100 standards are promulgated.

(2) After approval by the AELR committee of the
Maryland General Assembly, these guidelines will be published in
the Maryland Register and other appropriate media in order to
encourage their use and to offer guidelines against which owners
and/or operators of existing public buildings, including local
governments, the Department of General Services, and other
