WILLIAM DONALD SCHAEFER, Governor                   Ch. 308

(I) 1 SHALL BE THE SECRETARY OF THE DEPARTMENT
OF AGRICULTURE OR 1 THE DESIGNEE OF THE SECRETARY OF AGRICULTURE,
AS AN EX OFFICIO NONVOTING MEMBER;

(I) (II) 1 SHALL BE THE SECRETARY OF THE
DEPARTMENT OF NATURAL RESOURCES OR THE DESIGNEE OF THE SECRETARY
OF NATURAL RESOURCES, AS AN EX OFFICIO NONVOTING MEMBER;

(II) (III) 5 SHALL REPRESENT THE SEAFOOD
PACKERS IN THIS STATE, AT LEAST 3 OF WHOM SHALL BE MEMBERS OF THE
CHESAPEAKE BAY SEAFOOD INDUSTRIES ASSOCIATION;

(III) (IV) 2 SHALL REPRESENT THE MARYLAND

WATERMEN'S ASSOCIATION BE LICENSED MARYLAND WATERMEN;

(IV) (V) 1 SHALL REPRESENT THE RETAIL FOOD

INDUSTRY IN THIS STATE;

(V) (VI) 1 SHALL REPRESENT THE AQUACULTURE

INDUSTRY IN THIS STATS; AND

(VI) (VII) 2 SHALL BE CONSUMER MEMBERS.

(4) (I) THE GOVERNOR SHALL APPOINT THE 3 MEMBERS
REPRESENTING THE CHESAPEAKE BAY SEAFOOD INDUSTRIES ASSOCIATION
FROM A LIST OF NAMES SUBMITTED TO THE GOVERNOR BY THE CHESAPEAKE
BAY SEAFOOD INDUSTRIES ASSOCIATION. THE NAMES ON THE LIST SHALL
BE THREE TIMES THE NUMBER OF VACANCIES;

(II) THE GOVERNOR SHALL APPOINT THE 2 MEMBERS
REPRESENTING THE MARYLAND WATERMEN'S ASSOCIATION FROM A LIST OF
NAMES SUBMITTED TO THE GOVERNOR BY THE MARYLAND WATERMEN'S
ASSOCIATION. THE NAMES ON THE LIST SHALL BE THREE TIMES THE

NUMBER OF VACANCIES; AND

(III) (II) EXCEPT FOR THE EX OFFICIO MEMBER,
AND THE MEMBERS REPRESENTING THE CHESAPEAKE BAY SEAFOOD
INDUSTRIES ASSOCIATION, AND THE MEMBERS REPRESENTING THE MARYLAND
WATERMEN'S ASSOCIATION, THE GOVERNOR SHALL APPOINT EACH MEMBER
WITH THE ADVICE OF THE SECRETARY; AND

(III) EXCEPT FOR THE EX OFFICIO MEMBER, EACH
MEMBER APPOINTED BY THE GOVERNOR SHALL BE APPOINTED WITH THE
ADVICE AND CONSENT OF THE SENATE.

(5)  BEFORE TAKING OFFICE, EACH APPOINTEE TO THE
COMMISSION SHALL TAKE THE OATH REQUIRED BY ARTICLE I, § 9 OF THE

MARYLAND CONSTITUTION.

(6)  THE TERM OF A MEMBER IS 4 YEARS.

(7)  A MEMBER MAY NOT SERVE MORE THAN 2 TERMS ON THE
COMMISSION.
