Former subheading "Economic Stabilization Act" became
Title 7, Subtitle 3 of this article when the sections
of Article 41 were renumbered pursuant to Ch. 5 of the
Acts of 1986.

(b) (2) Prior to publication pursuant to [§ 245 of this
article] §§ 10-111(A) AND 10-112 OF THE STATE GOVERNMENT ARTICLE,
there shall be submitted to the Secretary any proposed rule or
regulation of any of the divisions, boards, commissions, offices,
and other agencies within the jurisdiction of the Department.
When the rule or regulation pertains to the regulatory,
supervisory, quasi-judicial, disciplinary or enforcement duty or
function of such division, board, commission, offices, or other
agencies, the Secretary may, within 30 days after presentation,
disapprove any rule or regulation if he determines that it:

(i) Would discourage competition within a
licensed or regulated occupation or profession;

(ii) Would unfairly restrict entry of
applicants into a licensed or regulated occupation or profession;
or

(iii) Is otherwise contrary to the public
interest.

DRAFTER'S NOTE: This corrects an outdated cross-reference
in Article 41, § 8-104(b)(2).

The substance of Article 41, § 245 became §§ 10-lll(a)
and 10-112 in Ch. 284 of the Acts of 1984.

The outdated cross-reference was noted by the Michie
Company.

(d) (1) The terms of the members who are not cabinet
members, or who do not represent the Maryland Disability Law
Center OR THE OFFICE ON AGING, shall be 4 years beginning July 1,
1986.

DRAFTER'S NOTE: This clarifies language in Article 41, §
10-601(d)(1).

Ch. 726 of the Acts of 1986 provided that the
Domiciliary Care Facilities Board has 9 voting
members, including the Secretaries of State Planning,
