Health" and Mental Hygiene; and Human Resources, the
Director of the Office on Aging, a representative of
the Maryland Disability Law Center; a domiciliary care
provider, and three consumer members. In providing
for terms of office of 4 years for members of the
Board "who are not cabinet members, or who do not
represent the Maryland Disability Law Center", Ch. 726
appeared to provide for a 4-year term for the Director
of the Office on Aging. Since the Director, like the
cabinet officers on the Board; serves at the pleasure
of the Governor, this is a nonsensical and unlikely
result, and clearly not within legislative intent.

The clarification was suggested by the State Attorney
General in his bill review letter of May 12, 1986.

11-202.

The Secretary of Economic and Community Development, with
the approval of the Governor, shall appoint a Director of the
Division of Economic Development; The [position of] Director
shall hold office at the Secretary's pleasure. He may be removed
by the Secretary of Economic and Community Development, with the
approval of the Governor. Any such removal by the Secretary of
Economic and Community Development is final and is not subject to
any appeal. The Director shall be selected because of his known
experience and interest in the development of natural resources
and industrial opportunities. The Director shall operate this
Division under the direction of the Secretary of Economic and
Community Development in accordance with the provisions of the
law relating to establishment of the Department of Economic and
Community Development.

DRAFTER'S NOTE; This clarifies language in Article 41, §
11-202.

The language being clarified was amended nonsensically
in Ch. 173 of the Acts of 1986.

The clarification was suggested by the Michie Company.

11-301.

(b) The Community Development Administration is hereby
created as a division of the principal Department of Economic and
Community Development to coordinate the various activities and
programs which may contribute to sound community development, to
encourage and facilitate the development of new and existing
communities by reducing the costs of development through grants
and loans, to encourage and facilitate energy conservation and
the utilization of solar energy in housing and commercial
buildings by providing grants, loans, and other forms of
financial assistance, making available land for such development
