(2) An employee organization may not be denied

certification as the exclusive representative of any police
officers solely for the reason that it:

(i) admits to membership rank and file

employees in addition to supervisory and/or professional

employees; or

(ii) affiliates with another employee

organization which admits membership rank and file, supervisory,
or professional employees.

(C) THE POLICE COMMISSIONER AND THE MAYOR AND CITY COUNCIL
SHALL RECOGNIZE AND BARGAIN WITH ANY EMPLOYEE ORGANIZATION
DETERMINED TO BE THE EXCLUSIVE REPRESENTATIVE OF ALL CLERICAL AND
ADMINISTRATIVE EMPLOYEES OF THE DEPARTMENT AFTER THE CONDUCT OF A
SECRET BALLOT ELECTION IN WHICH SUCH ORGANIZATION IS CHOSEN BY
MAJORITY VOTE AMONG SUCH CLERICAL AND ADMINISTRATIVE EMPLOYEES.
ANY UNIT FOR BARGAINING COMPOSED OF CLERICAL AND ADMINISTRATIVE
EMPLOYEES OF THE POLICE DEPARTMENT SHALL NOT BE MERGED WITH OR
ACCRETED TO ANY OTHER UNIT OF EMPLOYEES EITHER WITHIN THE
DEPARTMENT OR WITHIN THE CITY OF BALTIMORE.

[(c)](D) This section shall be construed to be consistent
with and not to supersede other provisions of this subtitle,
including, by way of illustration and not as a limitation:

(1) The provisions of this subtitle regarding the
departmental budget; and

(2) The procedures or authority of the Board of
Estimates, or the City Council.

SECTION 2. AND BE IT FURTHER ENACTED, That (1) this Act
does not affect the terms of any labor agreement or understanding
between the City of Baltimore and the employees of the Baltimore
City Police Department which takes effect prior to July 1, 1987;
and (2) any such agreement or understanding shall have the same
force and effect as an existing Memorandum of Understanding
between an exclusive representative of those employees and the
Mayor and City Council of Baltimore.

SECTION 3. AND BE IT FURTHER ENACTED, That all laws or
parts of laws, public general or public local, inconsistent with
this Act, are repealed to the extent of the inconsistency.

SECTION 4. AND BE IT FURTHER ENACTED, That if any provision
of this Act or the application thereof to any person or
circumstance is held invalid for any reason, the invalidity shall
not affect the other provisions or any other application of this
