CHAPTER 251

(House Bill 990)

AN ACT concerning

Prince George's County - Board of Zoning Appeals

MC/PG 32-87

FOR the purpose of prohibiting the board of zoning appeals in
Prince George's County from staying the execution of certain
decisions of the board requiring the Board of Zoning Appeals
in Prince George's County to seek enforcement of any final
decision of the Board; requiring that any request for a stay
of final decision of the Board of Zoning Appeals be filed in
the Circuit Court of the county; requiring certain decisions
of the board of zoning appeals in Prince George's County,
specifically decisions concerning unlawful nonconforming
occupancy or use in a residential zone, to be binding and to
continue in force and effect unless modified or reversed by
the circuit court for the county; providing for the
applicability of this Act; and generally relating to certain
decisions of the board of zoning appeals in Prince George's
County.

BY repealing and reenacting, with amendments,

Article 28 - Maryland-National Capital Park and Planning

Section 8-111.1

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article 28 - Maryland-National Capital
Park and Planning Commission

8-111.1.

(A) (1) Any person aggrieved by the decision of the board

of zoning appeals of Prince George's County and a party to the

proceeding before it may appeal to the circuit court for the

county which shall have power to affirm the decision of the

board, or if the decision is not in accordance with law, to

modify or reverse the decision, with or without remanding the
case for rehearing as justice may require.
