SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.

(House Bill 434)

AN ACT concerning

Witnesses - Loss of Employment - Penalty

FOR the purpose of establishing a certain penalty for employers
who violate a provision prohibiting the dismal dismissal of
an employee who misses work in order to appear as a witness
in certain proceedings.

BY repealing and reenacting, with amendments,

Article - Courts and Judicial Proceedings

Section 9-205

Annotated Code of Maryland

(1984 Replacement Volume and 1986 Supplement)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

Article - Courts and Judicial Proceedings

9-205.

(A)  An employer may not deprive an employee of the
employee's job solely because of job time lost by the employee as
a result of the employee's response to a subpoena requiring the
employee to appear as a witness in any civil or criminal
proceeding, including discovery proceedings.

(B)  AN EMPLOYER THAT VIOLATES SUBSECTION (A) OF THIS
SECTION IS GUILTY OF A MISDEMEANOR AND ON CONVICTION IS SUBJECT
TO A FINE NOT EXCEEDING MAY BE FINED NOT MORE THAN $1,000.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1987.
