DRAFTER'S NOTE: This corrects a stylistic error in §
4-226(a) of the Agriculture Article.

The error occurred in Ch. 6 of the Acts of the First
Special Session of the General Assembly of 1973.

The error was noted by the Michie Company.

5-301.

(b) "Broker" means any person[,] who solicits, takes
orders, sells or distributes nursery stock in the State other
than a nurseryman or dealer.

DRAFTER'S NOTE: This deletes extraneous punctuation in §
5-301(b) of the Agriculture Article, for purposes of
clarity.

The extraneous punctuation, a comma, was added in Ch.
298 of the Acts of the General Assembly of 1975.

The extraneous punctuation was noted by the Michie
Company.

(d) "Nursery stock" means (1) any hardy plant or plant that
survives Maryland winters, including a deciduous or evergreen
tree, shrub, or woody vine whether cultivated, native, or wild,
and all viable parts of the plant; (2) any nonhardy plant or
plant part to be distributed in another state that requires
[plan] PLANT inspection and certification before entering that
state; and (3) any other plant included by the Secretary, if
regulating its movement is necessary to control any dangerously
injurious plant pest.

DRAFTER'S NOTE: This corrects a misspelling in § 5-301(d)
of the Agriculture Article.

The misspelling occurred in Ch. 37 of the Acts of the
Regular Session of the General Assembly of 1985.

The misspelling was noted by the Assistant Attorney
General to the Department of Agriculture.

6-103.

Registration fees constitute a special fund to be used only
to defray partially the cost of inspection, sampling, analysis,
and other expenses necessary for administering this subtitle.
Notwithstanding any other provisions of this Code, any unexpended
funds up to a maximum of $100,000 may not revert to the General
[Funds] FUND of the State at the end of the fiscal [years] YEAR.
