(3) THE DAY CARE CENTER SHALL PAY FOR ANY COSTS OF
OPERATION OF THE DAY CARE CENTER.

(D)  SPACE ORIGINALLY SET ASIDE FOR A GROUP DAY CARE CENTER
MAY BE USED FOR OTHER PURPOSES IF:

(1)  THE BUILDING HAS BEEN FULLY OCCUPIED FOR 30 180
DAYS; AND

(2)  AN APPLICATION TO OPERATE A GROUP DAY CARE CENTER
HAS NOT BEEN FILED UNDER PART I OF THIS SUBTITLE.

(E)  CHILDREN OF STATE EMPLOYEES SHALL HAVE PRIORITY OVER
OTHER CHILDREN IN ADMISSION TO A GROUP DAY CARE CENTER IN A
STATE-OWNED STATE-OCCUPIED BUILDING OR NEARBY BUILDINGS.

(F) (1) AFTER A GROUP DAY-CARE CENTER IN A STATE-OWNED
BUILDING HAS BEEN IN OPERATION FOR 5 YEARS, THE SECRETARY OF THE
DEPARTMENT OF GENERAL SERVICES SHALL ASSESS THE CHILD-CARE NEEDS
OF STATE EMPLOYEES USING THE GROUP DAY-CARE CENTER AND THE OFFICE
SPACE NEEDS OF THE OCCUPYING AGENCY.

(2) IF THE ASSESSMENT DEMONSTRATES A GREATER NEED FOR
OFFICE SPACE THAN FOR CHILD CARE, THE SECRETARY OF THE DEPARTMENT
OF GENERAL SERVICES MAY CLOSE THE GROUP DAY-CARE CENTER.

(1) AFTER A GROUP DAY CARE CENTER FOR CHILDREN OF
STATE EMPLOYEES HAS BEEN ESTABLISHED, THE DEPARTMENT OF HEALTH
AND MENTAL HYGIENE SHALL ASSESS THE CHILD DAY CARE NEEDS OF THE
STATE EMPLOYEES USING THE CENTER AT LEAST EVERY 5 YEARS.

(2) IF THE ASSESSMENT DEMONSTRATES THAT THE SERVICE
IS NO LONGER NEEDED OR FEASIBLE, THE SECRETARY OF THE DEPARTMENT
OF HEALTH AND MENTAL HYGIENE MAY CLOSE THE CENTER.

(3)  THE SECRETARY OF THE DEPARTMENT OF GENERAL
SERVICES HEALTH AND MENTAL HYGIENE SHALL GIVE THE GROUP DAY CARE
CENTER 90 DAYS WRITTEN NOTICE OF CLOSURE.

SECTION 3. AND BE IT FURTHER ENACTED, That this Act applies

only to State-occupied buildings acquired or constructed on or

after July 1, 1986. However, if there is suitable space in

existing State-occupied buildings or nearby buildings the

Department of Health and Mental Hygiene may contract for group

day-care centers under this Act.

SECTION 3 4. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1986.
