(2) PROVIDE FOR LICENSING OF GROUP DAY CARE CENTERS
FOR CHILDREN OF STATE EMPLOYEES;
(3) ENSURE THAT SPACE DESIGNATED WITHIN A STATE-OWNED
STATE-OCCUPIED BUILDING OR NEARBY BUILDINGS FOR A GROUP DAY CARE
CENTER COMPLIES WITH THE PREVAILING LOCAL AND STATE SAFETY
BUILDING CODES FOR GROUP DAY CARE CENTERS; AND
(4) ADOPT AND ENFORCE REGULATIONS THAT SET STANDARDS
NECESSARY FOR THE SAFETY OF THE CHILDREN IN THESE
APPLY THE REGULATIONS ADOPTED UNDER TITLE 14 OF THIS ARTICLE FOR
GROUP DAY CARE CENTERS .; AND
(5) ESTABLISH OR CONTRACT FOR DAY CARE SERVICES IN
THE SPACE PROVIDED. CONTRACT PROVIDERS MUST PROVIDE PROOF OF
FINANCIAL RESPONSIBILITY.
(C) (1) THE DEPARTMENT OF GENERAL SERVICES SHALL:
(1) SET FORTH THE TERMS AND CONDITIONS FOR
UTILIZATION OF SPACE IN A STATE-OWNED BUILDING FOR GROUP DAY-CARE
CENTERS, INCLUDING TERMS FOR:
(I) PAYMENT OF RENT;
(II) PROOF OF FINANCIAL RESPONSIBILITY; AND
(III) MAINTENANCE OF SPACE.
(2) ESTABLISH THE RATE AT WHICH THE COST OF SPACE
MADE AVAILABLE FOR GROUP DAY-CARE CENTERS IS DETERMINED, BASED ON
THE LESSER OF:
(I) THE ACTUAL COST TO THE STATE;
(II) THE AVERAGE COST OF STATE-OWNED SPACE IN
THE AREA; OR
(III) THE STATEWIDE AVERAGE COST OF STATE-OWNED
SPACE.
(I) CONSTRUCT OR ACQUIRE THE REQUIRED SPACE TO
BE USED BY THE GROUP DAY CARE CENTER, WHICH SPACE SHALL BE
SUBMETERED FOR UTILITIES AND THE COSTS OF WHICH SHALL BE PAID BY
THE DAY CARE CENTER; AND
(II) INSPECT THE FACILITY MONTHLY AND INFORM
DAY CARE CENTER PERSONNEL OF MAINTENANCE DEFICIENCIES TO BE
CORRECTED BY THE DAY CARE CENTER.
(2) IF ANY DEFICIENCIES UNDER PARAGRAPH (1)(II) OF
THIS SUBSECTION ARE NOT CORRECTED WITHIN A REASONABLE TIME, THE
DEPARTMENT OF GENERAL SERVICES SHALL NOTIFY THE DEPARTMENT OF
HEALTH AND MENTAL HYGIENE WHICH WILL EXACT COMPLIANCE IN
ACCORDANCE WITH THE TERMS OF THE DAY CARE CENTER CONTRACT.
