SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That the Laws of Maryland read as follows:

5.09.

Article 28 - Park and Planning Commission

8-112.2.

IN MONTGOMERY AND PRINCE GEORGE'S COUNTIES PRINCE GEORGE'S
COUNTY, A CLUSTER ZONING OF RESIDENTIAL PROPERTY:

(1)  SHALL BE GOVERNED BY THE SAME LAWS, REGULATIONS,
AND PROCEDURES AS OTHER ZONING CLASSIFICATIONS;

(2)  IS SUBJECT TO THE "CHANGE AND MISTAKE" RULE; AND

(3)  MAY NOT BE ESTABLISHED BY SUBDIVIDING, BUT MUST
BE ESTABLISHED UNDER THE PROCEDURES REQUIRED FOR OTHER TYPES OF
ZONING OR REZONING.

SECTION 2. AND BE IT FURTHER ENACTED, That the provisions of
this Act may not be construed to affect property which has
received preliminary subdivision plat approval on or before
December 31, 1985.

SECTION 2 3. AND BE IT FURTHER ENACTED, That this Act
shall take effect July 1, 1986.
