Section 11-211(b) and (c)

Annotated Code of Maryland

(As enacted by Chapter ___ (S.B. 162) of the Acts

of the General Assembly of 1986)

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF
MARYLAND, That Section(s) 11-211(b) and (c) of Article - State
Finance and Procurement of the Annotated Code of Maryland (As

enacted by Chapter _____(S.B. 162) of the Acts of the General

Assembly of 1986) be repealed.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND SECTION 2. AND BE IT FURTHER ENACTED, That the Laws of
Maryland read as follows:

Article - State Finance and Procurement

12-101.

(b) The Board shall adopt regulations, consistent with this
Division II of this article, governing procedures for the review

and approval of procurement contracts including multiyear

contracts, conditions and procedures for delegating procurement

authority including designation of control authorities,

procedures for review of determinations, [and] procedures for
certification of adequacy of appropriations and availability of
funds, AND PROCEDURES FOR THE SUSPENSION AND DEBARMENT OF
PROSPECTIVE BIDDERS AND OFFERORS FOR UNSATISFACTORY PERFORMANCE
ON STATE CONTRACTS. The Board shall ensure that the regulations
of the procurement agencies provide for procedures which are
consistent with this Division ii of this article and which are
substantially the same among the agencies.

11-211.

(B) DEBARMENT PROCESSINGS MAY BE INSTITUTED WITHIN 5 YEARS
OF THE ACT, FINAL JUDGMENT, OR ADMISSION THAT CONSTITUTES GROUNDS
FOR DEBARMENT UNDER THIS SECTION.

(C) AFTER REASONABLE NOTICE TO THE PERSON INVOLVED AND
REASONABLE OPPORTUNITY FOR THAT PERSON TO BE HEARD, THE BOARD OF
PUBLIC WORKS MAY DEBAR A PERSON FOR CAUSE FROM BEING CONSIDERED
