applicants; the addition of a requirement that a firm that
makes application for a license as a private detective
agency appoint an individual as the "representative member"
of the firm and specifying the responsibilities of that
individual; the addition of mandatory certification
requirements for private detectives and security guards; the
addition of express disciplinary provisions for private
detectives and security guards and the deletion of
provisions that applied only on the denial of an
individual's application; the substitution of provisions
providing for the issuance of certification cards to private
detectives and security guards in lieu of the current
provisions for the issuance of identification cards; the
addition of a provision expressly authorizing a private
detective agency under certain circumstances to provide
uncertified individuals for hire as security guards; the
addition of a provision expressly providing that an
application for certification as a security guard be
submitted through a licensed private detective agency; the
addition of provisions expressly prohibiting an uncertified
individual from providing private detective services or
representing that the individual is authorized to do so; the
addition of a provision prohibiting an uncertified
individual from representing that the individual is a
certified security guard; the standardization of the
existing criminal sanctions for violation of these laws; and
generally relating to private detective agencies, private
detectives, and security guards; and otherwise for the
purpose of revising, restating, reorganizing, and
standardizing the structure of the laws of the State
regarding private detective agencies, private detectives,
and security guards, including the restatement of the
provisions regarding: the regulatory powers of the
Superintendent of the Maryland State Police; the licensing
of private detective agencies and the process for approving
individuals as private detectives and security guards; the
scope of a private detective agency license and of a private
detective and security guard certification; the provision of
security guard services by private detective agencies;
contingent on the passage of certain other acts, conforming
this Act to those other acts concerning the qualifications
of private detectives; and generally restating all aspects
of the laws relating to private detective agencies, private
detectives, and security guards.
