AN ACT concerning

Montgomery County - County Executive Zoning Authority

PG/MC 48-86

FOR the purpose of requiring the County Executive of Montgomery

County to approve or disapprove changes to the zoning
ordinance adopted by the district council within a certain
time period; providing for a process to allow the district
council to override the disapproval of changes to the zoning
ordinance by the County Executive; and generally relating to
the authority of the County Executive over changes to the
Montgomery County Zoning Ordinance.

SECTION 1. BE IT ENACTED BY THE GENERAL ASSEMBLY OF

MARYLAND, That the Laws of Maryland read as follows:

Article 28 - Maryland-National Capital Park and

Planning Commission

8-102.1.

(A) (1) IN MONTGOMERY COUNTY, ON THE ADOPTION OR AMENDMENT
OF THE TEXT OF THE ZONING ORDINANCE BY THE DISTRICT COUNCIL, THE
ORDINANCE SHALL BE DELIVERED WITHIN 3 DAYS TO THE COUNTY
EXECUTIVE WHO WITHIN 10 DAYS THEREAFTER SHALL APPROVE OR
DISAPPROVE THE ORDINANCE.

(2) IF THE COUNTY EXECUTIVE DISAPPROVES THE
ORDINANCE, IT SHALL BE RETURNED TO THE COUNCIL WITH THE REASONS
FOR THE DISAPPROVAL STATED IN WRITING.
