1952                                       LAWS OF MARYLAND                                    Ch. 538

IN MONTGOMERY COUNTY, THE COUNTY EXECUTIVE SHALL APPOINT 2
MEMBERS OF THE PLANNING COMMISSION FROM A LIST OF APPLICANTS. THE
LIST SHALL BE OPEN TO THE PUBLIC AT ALL TIMES AND SHALL BE
COMPLETED AT LEAST 3 WEEKS BEFORE APPOINTMENT OR REAPPOINTMENT.
IF THE COUNTY EXECUTIVE DOES NOT APPOINT AN INDIVIDUAL WHOSE NAME
APPEARS ON THE LIST OR IF NO NAME APPEARS ON THE LIST, THE COUNTY
EXECUTIVE SHALL PROVIDE FOR THE PREPARATION OF A SECOND LIST AND
SHALL FOLLOW THE PROCEDURES APPLICABLE TO THE FIRST LIST. WITHIN
3 DAYS OF THE APPOINTMENT BY THE EXECUTIVE, THE NAMES OF THE
APPOINTEES SHALL BE DELIVERED TO THE COUNTY COUNCIL WHICH SHALL
WITHIN 30 DAYS THEREAFTER EITHER APPROVE OR DISAPPROVE THE
APPOINTMENTS. AN APPOINTMENT THAT IS NOT DISAPPROVED BY THE
COUNTY COUNCIL IN THE MANNER PROVIDED IN THIS TITLE IS DEEMED TO
BE APPROVED. THE EXECUTIVE APPOINTEES MAY NOT BE OF THE SAME
POLITICAL PARTY.

AFTER DECEMBER l, 1986, THE COUNTY EXECUTIVE SHALL APPOINT
MEMBERS TO THE NEXT 2 VACANCIES ON THE COMMISSION. THE COUNTY
COUNCIL SHALL APPOINT MEMBERS TO THE FOLLOWING 3 VACANCIES ON THE
COMMISSION. APPOINTMENT OF MEMBERS OF THE COMMISSION SHALL

FOLLOW THIS PATTERN. All appointments or reappointments shall be
subject to § 2-114 of this article.

2-103.

SUBJECT TO THE APPROVAL OF A MAJORITY OF THE COUNTY COUNCIL,

[The] THE County [Council] EXECUTIVE of Montgomery County may
remove any members from that county THE COUNTY COUNCIL OF

MONTGOMERY COUNTY MAY REMOVE ANY MEMBERS FROM MONTGOMERY COUNTY
THAT THE COUNTY COUNCIL HAS APPOINTED AND THE MONTGOMERY COUNTY
EXECUTIVE MAY REMOVE ANY MEMBERS FROM MONTGOMERY COUNTY THAT THE
COUNTY EXECUTIVE HAS APPOINTED TO THE COMMISSION. REMOVALS MAY

OCCUR prior to the expiration of the term for which they were
appointed. The county executive of Prince George's County may

remove at his pleasure any members from that county prior to the
expiration of the term for which they were appointed, subject to
the approval of the County Council of Prince George's County by a
vote of a majority of the full Council. In each case, the cause
of removal shall be stated in writing and a public hearing held
on the removal. However, in Prince George's County the Commission
member sought to be removed may waive in writing the public
hearing held by the Council. Further, this provision does not
apply to any Prince George's member of the Commission in office
on June 1,' 1975 for the member's current term of office. Any
vacancy occurring in the membership of the Commission from
Montgomery County —[—for any cause shall be filled by the County

Council , FOR COUNCIL APPOINTED MEMBERS AND BY THE EXECUTIVE FOR

EXECUTIVE APPOINTED MEMBERS for the unexpired term and any
vacancy occurring in the membership of the Commission from] OR
Prince George's County shall be filled in the manner provided in
this title for the making of appointments to the Commission. A
person appointed to fill any vacancy for an unexpired term shall
be a member of the same political party as was represented by the
member who vacated the office.
