HARRY HUGHES, Governor                                    1949

approval of the County Council. Upon submission of the name of
the appointee to the County Council, the County Council shall
hold public hearings on the appointment not less than ten days
and not more than 20 days after submission. If the Council fails
to act to confirm or reject the appointment within 30 days of the
submission to the Council by the county executive, the
appointment stands approved. A vote of a majority of the full
County Council is required to confirm or reject an appointment.
All members of the Commission to be appointed from Montgomery
County shall be appointed by the County Council subject to the
approval of the county executive, as is provided in this

title. IN MAKING AND APPROVING SUCH APPOINTMENTS, THE COUNTY
COUNCIL AND COUNTY EXECUTIVE SHALL ATTEMPT TO PROVIDE REASONABLE
GEOGRAPHIC BALANCE WITH RESPECT TO THE PLACES OF RESIDENCE OF THE
MEMBERS. THE APPOINTMENT RESOLUTION FOR EACH APPOINTMENT SHALL
DESCRIBE THE RESULTING GEOGRAPHIC DISTRIBUTION AND PROVIDE
APPROPRIATE EXPLANATIONS. Upon appointment, the name of the
appointee shall be delivered within three days to the county

executive who within 30 days thereafter shall either approve or
disapprove the appointment. In the event that the county
executive disapproves an appointment, he shall return it to the
Council with the reasons for his disapproval stated in writing.
The Council may, by the affirmative vote of five of its members,
appoint a member of the Commission over the disapproval of the
county executive. Any appointment which has not been disapproved
by the county executive in the manner provided in this title is
deemed to have been confirmed. In Montgomery County, the County
Council shall select its respective appointments or
reappointments from a list of applicants. This list shall be open
to the public at all times and shall be completed at least three
weeks prior to actual appointment or reappointments. In the event
that the County Council does not appoint any individual whose
name appears on the list or in the event that no name appears on
the list, the County Council shall provide for the preparation of
a second list and shall follow the procedure applicable to the
first list. All appointments or reappointments shall be subject
to § 2-114 of this article.

SECTION 2. AND BE IT FURTHER ENACTED, That this Act shall
take effect July 1, 1986.

Approved May 13, 1986.
