and the mentally and physically disabled, and in meeting such
other needs as the Advisory Council to the program shall
identify.

(b)  No project shall be undertaken under the auspices of
the Maryland Service Corps if such project shall replace regular
workers or duplicate or replace an existing service in the same
locality.

(c)  No person may participate in any partisan political
activity while engaged in the performance of his duties under the
Corps, and the provisions of this subtitle shall be effective
only to the extent that they do not conflict with any federal or
State laws or regulations relating to participation in partisan
political activities.]

[364B.

(a)  The Maryland Service Corps shall be part of the State
Department of Employment and Social Services. The Secretary of
Employment and Social Services, with the approval of the
Governor, shall appoint an Administrator of the Corps who shall
be chief administrative and executive officer thereof. The
Administrator shall not be subject to the provisions of Article
64A of this Code, and he shall receive such salary as is provided
in the budget from time to time.

(b)  The exercise of all authority, duties, and functions
vested in the Maryland Service Corps or the Administrator thereof
by the provisions of this subtitle or by any other laws of this
State shall be subject to the authority of the Secretary of
Employment and Social Services.]

[364C.

(a)  The Corps may employ professional, technical, clerical,
stenographic, and other personnel to carry out its duties and
functions within the limits of budgetary appropriations. The
employees of the Corps, except the Administrator, shall be
subject to the provisions contained in Article 64A of the Code,
title "Merit System." Prior to July 1, 1973 the number of
corpsmen and corpswomen participating in the Corps shall not
exceed the number required to produce the equivalent of 100
volunteer man years. Thereafter, the number of corpsmen and
corpswomen participating in the Corps shall be determined by the
needs of the community and by the limits of budgetary
appropriations. The corpsmen and corpswomen participating in the
program shall make a commitment of one year of service, and shall
receive no salary, but they shall receive living allowances
commensurate to their basic needs.

(b)  In the performance of its duties, the Corps is hereby
authorized and empowered to make and enter into contracts and to
assume such other functions as are necessary to carry out the
provisions of this subtitle that are not inconsistent with this
