(ii) The ABSOLUTE divorce [a vinculo

(a)  A person may not operate a bicycle on any highway, or
on any roadway while the person is wearing any headset covering,
or any earplugs in, both ears.

(b)  The provisions of this section do not apply to:

(1)  Any person wearing personal hearing protectors in
the form of custom earplugs or molds that are designed to
attenuate injurious noise levels[. The], IF THE custom plugs or
molds [shall be] ARE designed in such a manner as to not inhibit

the wearer's ability to hear a siren or horn from an emergency
vehicle or a horn from another vehicle;

(2)  Any person wearing a prosthetic device used to
aid the hard of hearing; or

(3)  Any person operating a bicycle on a public
bicycle pathway expressly authorized for the use of persons
operating bicycles.

SECTION 2. AND BE IT FURTHER ENACTED, That Section(s)

2-103.1(d) through (f), respectively, of Article - Transportation
of the Annotated Code of Maryland be renumbered to be Section(s)
2-103.1(c) through (e), respectively.

SECTION 3. AND BE IT FURTHER ENACTED, That the provisions
of this Act are intended solely to correct technical errors in
the law and that there is no intent to revive or otherwise affect
law that is the subject of other Acts, whether those Acts are
signed by the Governor prior to or after the signing of this Act.

SECTION 4. AND BE IT FURTHER ENACTED, That this Act shall

take effect July 1, 1986.
