91 Novembr Co.rt 1716 Said James Sankston then and there being found feloniously did Steal take and bear away against the peace of the Said Lord Proprietor his rule and dignity and against the forme of an Act of Assembly of this Province now in force in Such Cases made and Provided Johnson pr Dno prprietor which bill was endorsed as folls vizt Billa vera pr me Simon Wilmer Fforeman : The Same Thomas app.rs to ye Same in propr person and prays he may have Council assignd him order’d that Mr Thomas Bowne be his Council To which Indictm.t he pleads not guilty & for tryall puts himself on God and the Country Hues in prpr prsona And he who prosecutes for the Ld Proprietor in like manner Johnson on which Command was given to the Sherf of Kent County that he Immediately cause to come here twelve &ca. to Recognize &ca who neither &ca. Because as well &ca. And the Sherf makes return that he hath here Ready twelve as by his precept it was Commanded vizt Samuel Thomas Ebenezr Blackiston James Murphey Roger Hailes Fredrick Hanson Daniel Farlo Richard Davis Francis Bellows Edward Davis Samuel Norris Benjamin Blackleage Zachariah Macdaniel which Jury being duely Elected tryd & Sworn and having heard the pleadings allegations and Evidences on both Sides do with :draw from the barr and after Some time do againe return to the barr and being called over as also the prisoner who do all appr. and being asked whether they are agreed on a verdict do Say they are agreed on a verdict and whether they find the prisoner Guilty or not guilty as he Stands indicted do Say he is not guilty as he Stands Indicted and by Samuel Thomas there foreman all so Say the Sd Thomas by his afd Council prays Judgment on the verdict Therefore it is Considered by the Court here vizt. this twenty third day of Novembr Anno Domi one thousand Seven hundred and Sixteen That as to the afd Indictment the afd Thomas Hues go thereof without day and that he be therfrom acquited Paying his fees amounting to the Sume of One Tousand and two pounds of Tobo. to whom they are due ordered that he be kept in Custody by the Sherf Said Coty untill he Shall give Security for his fees . . on which M.r Michael Miller comes into Cort. and Acknowledges that he will pay all fees on the afd Indictment~ ordered that he give Surety for appearance to next Co.rt and good- behaviour in the mean while . on which the afd Thomas comes into Court and acknowledges himself Indebted to his Lord Ship his - heires |
