84 Novbr. Court 1716 Thomas Bowne his attry and the Deft afd by his afd attry who pleads as folls vizt And the afd Joseph Milbe by James Earle his attry Says that he the Said Joseph did not assume in manner & forme as ye afd William— above in his Declaration against him hath declared and of this he . puts himselfe upon ye Country J Earle pr Deft~ And the plt in like manner TBowne pr Querr Thereupon Command was given to the Sherf of Kent- County that he Immediately cause to come here twelve &ca By whome &ca. To Recognize &ca. who neither &ca. Because as well &ca and the Sherf comes and makes return that he hath here ready twelve as by his precept it was Commanded who being called likewise came viz.t Samuel Thomas Ebenezr Blackiston James Murphey — Roger Hailes Fredrick Hanson Daniel Farrilo Richard Davis Frans Bellowes Christopher Bellican Edward Davis Saml. Norris Benjn- Blackleage who being duely elected tryd and Sworn and having heard the pleadings And the Plt afd proves his afd Acco.t~ as it Stands Stated And having heard the Evidences and allegations on both Sides The Court having Given them a charge do with draw to Consider and after Some time do againe return to the barr and being Called over as also the Plt & Deft~ do appr. and the Jury being asked whether they are agreed on a verdict do Say they are agreed on a verdict and being demanded whether they find for the Plt or Deft do Say they find for the Plt~. As to the first assumption ye Deft did assume in manner and form as above declared & find Damages Six hundred pounds of Tobacco as to the Second assumption he did not assume in manner and forme as above declared as to the third assumption in the above Declaran. Set forth ye Deft~. did assume in manner and forme as above declared and find damages two hundred and forty pounds of Tobacco with . Cost of Suite And by Samuel Thomas there foreman all so Say - on which the afd Plt~ by his afd attry prays Judgment on the verdict afd with Cost thereon accruing: Therefore it is Considered by the Court here viz this twenty Second day of Novemb.r Anno Domini One Thousand Seven~ hundred and Sixteen That the afd Plt William Browne do recover against the Said Deft~ Joseph Milbe as well the afd Sume of Six hundred pounds of Tobacco and two hundred and forty pounds of Tobacco amounting in the whole to the Sume of Eight hundred and forty pounds of Tobacco Damages as also the Sume of fifteen hundred and twenty two pounds of Tobacco Cost by the Said Plt about his Suite in this behalfe Expended and by the Court here of his assent adjudged and the Said Deft~ in mercy Jams Smith Clk John |
