Novbr Court 1716 83 Joseph had then and there last Said retained and imployed a Certain Zachariah— Brown Son and Servt. of the Said William in his the Said Joseph Service for the time and Space of twelve days in an Acco.t hereto annexed Shewn upon— himselfe assumed and to the Sd William then and there last Said fathfully Promised that he the Said Joseph So much Merchantable Tob.o as the Said William for the afd Service of his afd Son and Servant imployed retianed as afd Should reasonably deserve unto the Said William when thereunto afterwards required would well and truly pay & Content and the afd and the afd William in deed Saith that for the afd Services of his afd Son and Servant retained and Imployed as afd he reasonably deserves the Sume of Three hundred and Sixty pounds of Merchant :able Tobacco of which the Said Joseph then and there last Said had notice in an Acco.t~ hereto annexed are Specifically Shewn Nevertheless the afd Joseph his Severall Promises and assumptions afd in forme afd made — litle minding but fraudulently Intending the afd William in that behalfe to deceive and defraud the afd Severall Sums of Tob.o in ye whole amounting to the Sume of fifteen hundred & Sixty pounds of Merchantable Tob.o to the Same William altho afterwards vizt. the fourth day of May and often after in the year of our Ld Christ Seventeen hundred and fifteen he was at~ Kent County afd within ye afd Jurisdiciõn thereto required hath not paid nor made Content~ for the Same but the Same to pay or Content the Said Joseph hitherto hath denied & yet denys to the damage of the Said William Two — thousand pounds of Merchantable Tobacco and thereupon he brings Suite &ca. TBowne pr Querr Plegs &ca. Jno Doe & Rd Roe Mr. Joseph Milbe Dr. 1714 = 9ber 17 To building of one Dwelling house 20 foot & 15 Clap boards drawn and Laying one floore 600 Son to Virginia at 30 day 360 pr me William Brown————— And the afd Deft. by James Earle his attry apprd to the above . accõn~ and prayd liberty thereof to imparle thereto and to answer at~. next Court which was granted the Same day was given the Plt~ also — Att which Said next Court vizt the fifteenth day of Novembr. Anno- Domi Seventeen hundred and fifteen the Same accõn was Continued untill the then next Court in Course Att which Sd next Court Vizt the twentieth day of March the Same year last— mentioned the Said Cause was Continued untill ye then next Court in Course Att which Said next Court vizt the nineteenth day of June Anno Domini— Seventeen hundred and Sixteen the Sd cause was Contined untill ye then next Co.rt in Course Att which Sd next Court vizt. the twenty first day of August the Same year last~. mentioned the Said cause was Continued untill the then next Court in Course— Att which Sd next Court viz.t this twenty Second day of Novemb.r the Same year last mentioned the Sd cause Standing for tryall Came the afd Plt~ by Thomas |
