8 June Court 1716 and that he have then and there Said writ &c.a Att which Said next Court viz this [ni]neteenth day of June Anno Domini One Thousand Seven hundred and Sixteen the day of return of Said writ Came William Frisby Gent high Sherf of Said County and made return there of in these words thereon Endorsed as foll viz.t Cepi Corpus pr nbsp; Wm Ffrisby Sherf. And now at this Court the Said Deft. being Called Came And the Said Plt by Thomas Bowne his attry prays that the Said Deft may give Special bayle to the above accõn which was granted and that he be kept in Safe Custody by the Sherf of Said County until he Shall give Special bayle The afd Plt by his afd Attry prays that he may put in Security to the above accõn that if the Deft afd Should appear and plead and the Plt Should be Cast in the Same on which M.r Thomas Bowne Comes into Court and acknowledges himself Security for the afd Plt in the above accõn and Saith that if the Plt afd is Ca[st] in the Same that the Deft Cost he will pay if the plt afd do not A Declaration being fild in the Said Accõn and a Copy thereof Served With the writ according to Act of Assembly in Such Cases made was as folls viz Kent County Ss Thomas Taylor of Kent County Planter alis Dics Thomas Taylor of Kent County Planter was Summoned to Answer unto Richard Bennett of a plea that he render to him the~ full & just Sume of one thousand Sixty Six pounds of good Sound Marchantable leafe Tobacco & Cask of ye value of Eighty Eight Shillings & tenn pence Sterling money which he unjustly detains and four Shillings Six pence Sterling money which to him he oweth & from him unjustly detainteth &c.a And whereupon ye Said- Richard by Thomas Bowne his Attry Saith that whereas ye afd Thomas Taylor the Seventeenth day of March Anno Domini Seventeen hundred and Six at St. Pauls parish in Kent County afd within the Jurisdiccõn of this Court by his Certain Bill obligatory which the Said Thomas Taylor Sealed with his Seale & as his deed delivered here into Court brought the date whereof is the Same day and Year afd bound himselfe to pay or cause to be paid unto ye afd Richard and a Certain Thomas Ringgold Ex.r of Elias King or either of them which Said Thomas Ringgold is now dead when the Said Richard Survi^ved, the afd full & just Sume of one Thousand Sixty Six pounds of Tobacco qualified as afd in Cask of the afd value of Eighty Eight Shillings – & tenn pence Sterling money Convenient in Kent County afd and the afd four Shillings Six pence Sterling money on or before the first day of Aprill next Ensuing the date of the afd Bill Yet the afd Thomas Taylor altho’ often required the afd one thousand Sixty Six pounds of Tobacco & the Said four Shillings & Six pence to the Said Richard & Thomas Ringgold or to either of them in the life of the Said Thomas Ringgold or to the Said Richard after the death of the Said Thomas Ringgold whom then Said Richard Survived hath not rendered or caused to be rendered but that to them to render he hath altogether denied and the Same to the Said Richd hitherto hath denied and doth deny and the Tobacco afd doth unjustly detain- & whereupon the Said Richard Saith he is damnified one hundred & fifty Shills Sterling money & thereupon he brings Suite &c.a TBowne pr Quer Ps &ca Jno Do & Rd Roe And |
