before his Said Lord Ships Justices of the next Court to be held at our Court house in – the Town of Chester in Said County to answer unto Alexander Williamson Clark – principall vestry man and his brethren vestry men of S.t pauls parish in Kent County afd of a plea that he render to them the full and just Sum of one Thousand two hundred pounds of good Merchantable leafe Tobacco in Cask to Containe the Same of the value of five pounds Sterling money of Great Brittaine which from them he unjustly detains &c.a And that he have then and there the Said writ &c.a . . . . . . . At which Said next Court vizt this nineteenth day of June Anno Domini One Thousand Seven hundred and Sixteen the day of return of Said writ Came Will.m Frisby Gent high Sherf of Said County and made return thereof in these word thereon endorsed as folls viz.t Cepi Corpus pr Wm Ffisby Sherf And the Said Deft being Called Came And the afd Plts by Thomas Bowne their attry and prayd that the Said Deft might give Special bayle to the above accõn which was granted and that he be kept in Safe Custody by the Sherf of Said County until he Shall give Special bayle . . After which Came Thom.s Tolley of Said County into Court and acknowledged himselfe Special bayle to the above accõn and undertakes the payment of the Debt afd and Cost thereon accruing if it Shall happen that the Said Plts Should obtain Judgment against the Said Deft. in the Said Accõn of Debt and the Said Deft. the Condemnation Shall not Satisfie nor himselfe to the Custody of the Sherf of Said County deliver or that the afd Thomas Tolley the body of the Said Deft. Shall not render &c.a After which the afd Deft~ in his proper person appeared to the above accõn and prayd liberty thereof to imparle thereto and to answ.r at next Court which was granted the Same day was given the Plts also
