     78                                   Novbr. Court 1716
   gainsay ye Accõn afd nor but that ye writing obligatory above mentioned is
   his Act & deed and that he oweth the Said Plt~ ye Sume afd Debt and is
   willing that Judgment Should be entred for ye Same & Cost thereon accruing
   Therefore it is Considered by the Court here vizt this Twenty Second
   day of Novembr. Annoque Domini one Thousand Seven hundred and
   Sixteen That the Said Plt~ William Frisby do Recover against the
   Said Deft Christopher Rye as well the Sume of Three Thousand Three
   hundred and Eighty pounds of Tobo. Debt as also the Sume of four hundred
   and Nine pounds of Tobacco Cost by the afd Plt- about his Suite
   in this behalfe expended and by the Court here of his assent adjudged
   and the Said Deft. in mercy &ca.

   and that William Ringgold Gent- one of ye Coroners of this County keep the afd
   George in safe Custody untill he Shall give Special bayle as afd ——
   Richard Smithers & | Commanded it was to the Sherf of Kent County the
   Uxr Exxr Jno Carvill decd | twenty first day of August in the Second Year of the
             at | Dominion of Charles absolute Ld & Proprietarie of
   Benjamin Griffiths           | the Province of Maryland and Avalon Ld Baron of .
   Baltemore &ca. That he take Benjamin Griffiths of Kent County Taylor
   alis Dics Benjamin Griffith of Kent County in the Province aforesaid
   Tayler if he Should be found in his bailiwick & him Safe keep So that he -
   have his body before the Justices of our next County Court to be held at our Court~
   house in the Town of Chester in Said County to Answer unto Richard Smithers
   and Mary his wife late called Mary Carvill Execrx of ye last will & Testament.
   of John Carvill late of Kent County Gent deceased of a plea that he render to them
   the Just & full Sum of one Thousand pounds of Tobacco and the full and Just~.
   Sume of four hundred and forty pounds of good Sound bright Merchantable
   neat leafe Tobacco clear of ground leaves & all other trash every way well~
   qualified and in good well Seasoned Casque to Contain ye Same of ye value of -
   one hundred & twenty Shillings Sterling money which he unjustly detains and
   that he have then and there the Said writ~ &ca.   . Att which Said next Cort
   viz.t the twentieth day of Novemb.r the Same year last mentioned the
   day of return of Said writ Came William Frisby Gent high Sherf of of. ..
