Nov.br Court 1716 —— 77 &ca. And that he have then and there the Said writ~ &ca. Att which Said next Court vizt. the twentieth day of Novemb.r ye Same year last mentioned the day of return of Said writ Came Lambert Wilmer Gent one of the Coroners of this Coty and makes return thereof in these words thereon endorsed as folls vizt — Cepi Corpus pr Lamt. Wilmer Corr. And a Decln being filed when Said writ Issued forth and a Copy thereof Served therewith according to Act of Assembly in Such Case made was as folls vizt K.t County Ss Christopher Rye of Kent County Planter alis Dics Christopher Rye of ye afd County & province was Summoned to Answr. unto William Frisby Sheriff of Said County of a plea that he render to him ye full & just Sume of three thousand three hundred & Eighty pounds of Tobacco to be every way well qualified in Good Seasoned casque of ye value of fourteen pounds Sterling money which he unjustly detains &ca. And whereupon the Said Plt by Thomas Bowne his attry Saith that whereas ye afd Deft~. ye twenty nineth day of March Anno Dom Seventeen hundred and fifteen at S.t Pauls Parish in Kent County afd wthin the Jurisdiciõn of this Court by his certain writing obligatory which the Said Deft~. Sealed with his Seale & as his deed delivered hereinto Court brough[t] ye date whereof is the Same day & year afd Granted himselfe holden and firmly bounden to the Said Plt~ then Sherife of ye County afd being by ye name of William Frisby of ye Sd County Sherf in the afd full & just Sum: three thousand three hundred and Eighty pounds of Tobacco to be every way well qualified in Good Seasoned Casque of ye afd value of fourteen pounds — Sterling money to be paid to the Said Plt~ in Some Convenient place in the afd County to the Said Plts likeing when thereunto required Yet the afd Deft. altho’ often required the afd three Thousand three hundred and Eighty pounds of Tobacco to the Said Plt~ hath not rendered or paid but that to render or pay ye Said Deft hitherto hath denied & yet denys & unjustly detains to ye damage of the Said Plt~ twenty pounds Sterling money and thereupon he brings Suite &ca— TBowne pr qr. Pleg &ca — John Doe & Rd Roe and now at this Court the Said Deft~. being called Came and the Said Plt by his afd attry. and prays that the Said Deft might give Special Bayle to ye. afd accõn which was granted After which John Clarke of Said County here in Court came and Acknowledged himselfe Special baile in ye afd accõn and did under take for the afd Deft- ye payment of the debt afd and cost thereon accruing if in case ye Said Deft~ Shall be cast in the Same and the Condemnation afd Shall not Satisfie nor himselfe to the Custody of the Sherf of Said County deliv[d] or that the Said John Clarke the body of the Said Christopher Shall not render &ca. . . . After which the afd Deft~ in his proper person came into Court and appeared to the above accon and Saith that he Cannot~. gainsay |
