74 Nov.br Court 1716 in the Town of Chester in Said County to Answer unto Laughlin Flinn of a plea of Trespass on the Case and that he have then and there the Said writ &ca. . . . Att which Said next Court vizt. the twentieth day of Novemb.r the Same year last mentioned the day of return of Said - writ came William Frisby Gent high Sherf of Said County and made return thereof in these words thereon endorsed as folls vizt. Cepi Corpus pr Wm Ffrisby Sherf And a Decln Being filed folls vizt. Maryland K.t Coty Ss Thomas Jones of Kent County Planter was attached to answer unto Laughlin Flinn of a plea of Trespass on ye Case &ca. And Whereupon the Said Laughlin Flinn by James Earle his attry complains yt. whereas the afd Thomas ye tenth day of July Anno Domi one Thousand Seven hundred & Sixteen at Chester new Town indebted to the Said Laughlin in the Sum of one pounds fifteen Shills. and Six pence Currant money of Maryland being for divers - goods Sold & deliverd before that time by the Said Laughlin to the Said Thomas & at the Special Instance & request of the Said Thomas & being So Indebted the Same Thomas in Consideration thereof the day year and place above mentioned upon himselfe assumed - & to the Said Laughlin then and there faithfully promised that he the Said Thomas ye like Sum of money afd to ye Said Laugh when after thereunto required would well and truly Content & pay Nevertheless ye afd Thomas his promise and assumptions afd in forme afd made litle regarding but altogeather minding & fraudulently Intending him ye Said Laughlin in this part Craftily and Subtily to deceive & defraud ye afd Sum of five & thirty Shills. & Six pence Currt. money afd to ye. Said Laughlin hath not paid altho to do ye Same he was by ye Said Laughlin required at Chester new Town in Kt. Coty & within ye Jurisdiciõn afd to wit ye twelth day of July in ye Year Seven: :teen hundred & Sixteen afd & divers other days & times as well before as Since hath not paid but the Same to pay hath refused and Still doth refuse to the damage of the Said Laugh three pounds Currant money afd & therefore he brings this Suite &ca. Ja Earle pr Querr Plegs &ca. Jno Doe Rd Roe And the afd Plt~ comes into Court and takes his Corporall oath |
