6 June Court 1716 Kent County Maryland Ss John Tweig of Kent County planter alis Dics John Tweig of Kent County plan:r was Summoned to Answer unto Edward Scott of~ [Ken]t County Gent of a plea that he render to him the full & just Sume of Sixteen- hundred pounds of good Sound Merchantable leaf Tobacco in Cash and clear of trash & ground leafs of the value of thirteen pounds Six Shillings & Eigth~ pence Sterling money of Great Brittaine which he unjustly detains &ca- and Whereupon the afd Edward by Thomas Bowne his attry Saith that- whereas the afd John the twelfth day of Octobr Anno Domini Seventeen~ hundred and Eleaven at S.t Pauls Parish in Kent County afd within the Jurisdiccõon of this Court by his Certain bill obligatory which the Said John Sealed with his Seale & as his deed delivered hereunto Court brought the date whereof is ye Same day and year afd bound himselfe his heires Execrs & Admrs to pay or cause to be paid unto the afd Edward the afd full & Just Sume of Sixteen hundred pounds of good Sound Merchantable leafe Tobacco in Cask and clear of Trash & Ground leafs of the afd value of thirteen pounds Six Shillings & Eight pence Sterling money of Great Brittain Convenient in the afd County at or before the tenth day of 10.ber next ensuing ye date of the afd Bil yet the afd John alth’ often required the afd Sixteen hundred pounds of Tobacco to~ the afd Edward hath not rendered or paid nor caused to be rendered or paid but the Same to render or pay the Said John hitherto hath denied & yet denys & unjustly detains to the damage of the Said Edward Twenty pounds Sterling money of Great Brittain and thereupon he brings Sute &c.a. TBowne pr Querr. pledg &c.a Jn.o Doe & Richd Roe —— and now at this Court the Said Deft being called Came and the afd plt by his afd Attry prays that the afd Deft may give Special Bayle to the above accõn which is granted after which Came Isaac Ashley of Said County into Court and acknowledged himselfe Special bayle to the above accõn and undertakes the payment of the Debt afd & Cost thereon accrueing if it Should happen that the Said. Plt~ Should obtaine Judgm.t against the Said Deft~ in the Said Accõn of Deft and the Said Deft the Condemnation afd Shall not Satisfie nor himselfe to the Custody of. the Sherf of Said County deliver or that the afd Isaac the body of the Said John Shall not render &c.a . . . After which the afd John in his proper person came into Court and appeared to the above accõn Saith that he Cannot gainsay the accõn afd of him the Said Edward nor but that the writing above mentioned is his act and deed and that he oweth the Sume above mentioned and is willing that Judgm.t Shall be entred against him for the Same and the Cost thereon accrueing: : Therefore it is Considered by the Court here viz — this Nineteenth day of June Annoq Domini One Thousand Seven hundred & Sixteen That the afd Plt Edward Scott Recover against the Said Deft John~ Twegue as well the afd Sume of Sixteen hundred pounds of Tobacco Debt. as also the Sume of three hundred Sixty One pounds of Tobacco Cost~ by the Sd Plt. about his Suite in this behalf Expended and by the Court hereof [is?] by assent~ . adjudged and the Said Deft in mercy JamsSmith Clk |
