June Court 1716 5 that he [render] him the full & Just Sume of four pounds two Shillings and ten pence Sterling money which to him he oweth and from him unjustly detaineth an[d] five thousand five hundred Sixty two pounds of Tobacco which he unjustly de[tain]s &c.a and that he have then & there the Said writ &c.a . . . Att which Said next Court viz.t this nineteenth day of June Anno Domi one Thousand Seven hundred – & Sixteen the day of return of Said writ Came William Frisby Gent high Sherf of- Said County and made return thereof in these words thereon Endorsed as folls viz.t Cepi Corpus pr Wm Ffisby Sherf : And now at this Court Came the Said plt by Thomas Bowne his attry and the Said Deft. being Called Came and the Said plt by his afd attry prays that the Said Deft~ might give Special bayle to the above accõn which is granted and that he be kept in Safe Custody by the Sherf of Said County until he Shall give Special bayle as afd after which Came Robert. Park and Michael Hacket both of this County into Court and they and Either of them Acknowledged themselves Special bayle to the above accõn and joyntly & Severally [do?] undertake the payment of the Debt aft and Cost thereon accrue: :ing if it Shall happen that the Said Plt Shall obtaine Judgment against the Said Deft in the Said accõn of Debt and the Condemnation shall not Satisfie nor himselfe to the Custody of the Sherf of Said County deliver or that the afd Robert Park and Michael Hackett or either of them the body of the afd . Robert Maxfield Shall not render &ca . . and the afd Robert Max: :field in his proper person appeared to the above accõn and prayd liberty thereof to imparle thereto and to Answer at next Court which is granted y.e Same day is given the Plt in like manner
before his Said Lord Ships Justices of the next County Court to be held at our Court house in the Town of Chester in Said County to Answer unto Edward Scott of Kent County Gent of a plea that he render to him the full and Just Sume of Sixteen hundred pounds of good Sound Merchantable leafe- Tobacco in Cask and clear of trash and ground leafe of the value of thirteen pounds Six Shillings and Eight pence Sterling money of – Great Brittaine which he unjustly detains &ca And that he have then and there this writ &c.a . . Att which Said next Court viz.t this nine: =teenth day of June Anno Domini One Thousand Seven hundred & Sixteen the day of return of Said writ Came William Frisby Gent high Sherf of Said County and made return thereof in these words [thereon] endorsed as folls vizt Cepi Corpus pr Wm Frisby Sherf - and Declaration being fild when Said writ Issued forth and a Copy thereof Served therewith According to Act of Assembly in Such Cases made which followeth vizt Kent~ |
