    58                                       August Court 1716
   Att which Said next Court viz . this twenty first day of August Anno.
   Domi 1716 Came the afd Plt by their afd Atry   and the Deft in his
   proper person came and Said that he Cannot gainsay the Accõn afd of —
   them the Said Plts nor but that the writing obligatory above mentioned
   is his Act and deed and that he oweth the Sume afd mentioned &
   is willing that Judgment Should be entred for the Same & Cost Accruing -
   Therefore it is Considered by the Court here vizt the Same day last~
   mentioned That the afd Plts in their afd Capacitys Recover against
   the Said Deft Thomas Cooke- as well the afd Sume of one Thousand
   two hundred pounds of good Sound Merchantable leafe Tobacco the Debt
   afd and also the Sume of Three hundred and twenty four pounds of~
   Tobacco Cost by the afd Plt~ about their Suite in this behalfe Expended
   and by the Court here of his assent adjudged and the Said Deft~ in

        at | the twenty fourth day of March in the first Year of
   Chr Bateman | his Lord Ships Dominion &ca That he take Christopher
   —————— | Bateman of Kent County Taylor if he Should be found
   in his Baylwick and him Safe keep So that he have his body before
   his Said Lord Ships Justices of the next Court to be held at our Court house
   in the Town of Chester in Said County to Answer unto Thomas Hill
   of a plea of Trespass upon the case and that he have then and there
   the Said writ &ca. . Att which Said next Court viz the nineteenth
   day of June Anno Domini one Thousand Seven hundred &
   Sixteen the day of return of Said writ Came William Frisby Gent- high
   Sherf of Said County and made return thereof in these words thereon
   endorsed as folls viz.t Cepi Corpus pr Wm Ffrisby Sherf
   Att which Said Court Came the afd Deft by Thomas Bowne his —
   attry and appeared to the above Accõn and prayd liberty thereof to -
   imparle thereto and to Answer at next Court which was granted
   the Same day was given the Plt- also
    Att which Said next Court viz this twenty first day of August the
   Same Year last mentioned Came the afd Plt~ by James Earle his —
   Attry and the Said Deft~ by his afd attry . And the Deft~ by his —
   attry alleages that the Plt~ hath fild no Decln in the above cause -
   nor doth not Shew any reason why he Commenced his Accõn Therefore
