    56                                         August Court 1716
   before the Justices of our next County Court to be held at our Court house in—
   the Town of Chester in Said County in the third tuesday in June next—
   to Shew cause if any they have why Judgment Should not be rendered
   against them for the Debt and Cost in the Judgment afd mentioned
   and what y.o Shall do herein that y.o make known to the Justices of our
   Said Court at the day and Place afd hereof you are not to faile at yr Prill
   and have y.o then & there the names of the persons before whom~
   yo Shall make the Same known & this writ witness James Harris —
   Gent- chiefe Justice of our Said Court this 24th day of March in the first
   year of our Dominion &ca. Anno Domi 1715 Roberts pr Querr Jams Smith Clk
   Att which Said next Court viz . the nineteenth day of June Anno Domi
   1716 the day of return of Said writ Came William Frisby Gent high
   Sherf of Said County and made return thereof in these words thereon
   Endorsed as folls vizt. I do hereby certifie to the Justices within
   named that by vertue of the within writ to me directed I have made
   known to the within named Danll Pearce & Thomas Cooke (that they
   be and appear at the day & Place within mentioned) in ye prsence
   of Michael Hackett James Frisby Robert Thompson & Peter
   Arnoh [?] good & lawfull men of my Baylwick pr me Wm Ffrisby Sher
    Att which Said Court Came the afd Defts by James Earle their
   attry and appeared to the above writ of Sciri facias and prayd liberty
   thereof to imparle thereto and to Answr. at next Court which was —
   granted the Same day was given the Plt~ also
   Att which Said next Court vizt. this twenty first day of August the
   Same year last mentioned The Said Cause Standing for tryall Came
   the Said Plt by John Johnson his attry and the Said Daniel
   Pearce and Thomas Cook [In] their afd Capacities by James Earle
   theire attry and alleadged to the Court that the Plt being a foriner
   and at the appearance Court in the Said Accõn there was no Surety put
   to the Accõn that if he Should be Cast the   Defts might be Secured .
   there Cost~ in the County for want of which the Said Defts by their Attrys
   afd prays that a non suite may be given in the Said Cause Therefore
   it is Considered by the Court here vizt. this twenty first day of August~.
   Anno Domi one Thousand Seven hundred and Sixteen That the Said
   Plt~ Jedidiah Andrews take nothing by his writ of Sciri facias afd
   but that he be in mercy And That the Said Daniel Pearce & Thomas —
   Cooke go thereof without day It is Considered also that the Said Daniel
   Pearce and Thomas Cooke in their Capacities afd Recover against the afd
