nineth day of August Anno Domini one Thousand Seven hundred and - Eleaven before Coll William Pearce and his associates then Justices of - our late Lady Between Jedidiah Andrews of Philadelphia in ye Province of Pensil: :vania Gent~ Plt~ and Christopher Philipson of Kent County afd Gent- one of ye attorneys of Kent County Court afd alis Dics Christopher Philipson of Kent County in ye Province of Maryland Gent- Defendant the afd Plt Recovered Judgment against the Said Deft~ as well for the Sume of Thirty Recovered Currant Silver money of the Province afd Debt whereof he was Convict as appears upon Record the day afd as also the Sume of four hundred and forty five pounds of Tobacco Cost of Suite and for the Debt and Cost afd in the afd Judgment mentioned Satisfaciõn hath not. Yet been made by the Said Deft~ the afd Plt~ Issued out her late Majesties writ of Capias ad Satisfaciendum against the Said Deft~ according to the Judgment afd Returnable to the first Tuesday in March Anno Domini 1711 And the Sherf of Said County Came that day (to wit) the fourth day of March afd and returnd the afd Capias ad Sa: :tisfaciendum endorsed Non Est Inventus &ca. And as yet Satisfaciõn~ hath not been made by the Said Deft~ to the afd Plt Wee Therefore Command you that y.o make known unto Daniel Pearce of Kent County . Gent- and Thomas Cooke of Kent County Planter otherwise Called Daniel Pearce and Thomas Cooke of Said County who was the Special bayle of the Said Christopher Philipson and did then and there at the time and Place afd undertake for the Said Christopher Philipson the payment of the debt & Cost in the Judgment afd mentioned if it Should happen that the afd Jedidiah Andrews Should obtain Judgment against the Said Christopher Philipson in the Said Accõn afd and the Said Christopher Philipson the Condemnation Should not Satisfie nor humselfe to the Custody of the Sherf of Said County Surrender or that they the Said Daniel Pearce and Thomas Cooke the body of the Said Deft~ did not~ deliver &ca. And the Said Christopher Philipson having made no Satis: :faciõn of the debt and Cost in the Judgment afd mentioned That by - good and Lawfull men of your Baylwick you make known unto the Said Daniel Pearce and Thomas Cooke that they be and appear before |
