August Court 1716 52 ye Same day and year afd bound and obliged himselfe his [heirs] Exrs Admrs to pay to the afd James the afd Sume of five hundred and Eighty and Eight pounds of good Sound Marchantable leafe Tobacco in Cask to Contain the Same of the afd value of two pounds nine Shillings Sterlg money by ye tenth day of November Ensuing ye date of the Said writing obligatory Yet the afd Richard altho’ often required ye afd five hundred Eighty and Eight pounds of Tobacco unto the Said James hath not rendered nor paid nor caused to be paid but the Same to render or pay the Said Richard hitherto hath denied and yet denys & unjustly detains to ye damage of the Said James four pounds tenn Shillings Sterlg money & thereupon he brings Suite &ca- TBowne pr Querr Pls &ca Jno Doe & Richd Roe And the Said Deft~ in his proper person appeared to the above accõn and prayd liberty thereof to imparle thereto and to Answer at next Court which was granted the Same day was given the Plt also Att which Said next Court vizt. the nineteenth day of June Anno Domi 1716 the Same cause was Continued untill ye then next Court~ Att which Said next Court vizt. this twenty first day of August the Same year last mentioned the Said cause Standing for tryall Came the Said Plt. by Thomas Bowne his attry and the Said Deft~ being Solemnly called came not but made default by which the Said Plt may remain Still undefended Therefore it is Consi: dered by the Court here viz the Same day last mentioned That the Said Plt James Smith Recover against the afd Deft~ Richard Fulston as well the afd Sume of five hundred and Eighty and Eight~ pounds of Tobacco Debt and also the Sume of Three hundred and Eight pounds of Tobo Costs by the afd Plt about his Suite in this behalfe Expended and by ye Court here of his assent adjudged and that the Said Deft~ be taken into Custody &ca: Bill fild Jams Smith Clk
