   46                                  August Court 1716
   in the Same and A verdt. for the Plt~ and the Deft~ by his attr
   moved in arrest Judgment which was granted and Reasons being fild
   as by ye Same in that Courts proceedings may appear the Reasons—
   afd being argued the verdt. was Set a Side on which the Same Accõn
   was Continued untill the then next Court
     Att which Said next Court vizt. the nineteenth day of June Anno Domi
   1716 Came the afd Deft~ by his attry afd and the Plt by his attry afd
   and the Same Accon was Continued untill next Court~
   Att which Said next Court vizt. this twenty first day of August the
   Same year last [menti]oned Came the Said Plt~ by his attry afd and the
   Deft [by his attr]y afd. and pleads vizt And the afd John Hodges by
   John Johnson his attry comes and defends the force and Injury when
   &ca. And Saith that he did not assume upon himselfe in Such manner
   & forme as the afd George in his Decl afd agst. him above hath Supposed
   And for this he puts himselfe upon the Country Johnsoin pr Deft~.
    And the Plt~ in like manner TBowne pr Plt~
   Thereupon Command was given to the Sherf of Kt Coty that he
   immediately cause to come here twelve &ca. By whome &ca. to Recogniz:
   &ca Because as well &ca. who neither &ca. And the Sherf comes and Saith
   he hath here ready twelve &ca. as by his precept it was Commanded who
   being called came vizt. William Bower Arthur Foreman Thomas Bower
   Thomas Pryer James Ryley George Hanson John Blackiston Peter Green
   Thomas Hynson Robt Hodges Daniel Farrilo & John Brown—
   who being duely Elected tryd and Sworn and having heard the -
   pleadings and Proclamation being made that the Deft~ Should
   appear and defend the Accõn afd otherwise ye Inquest to go by default.
   And the afd Plt~ proves his Accot. as afd Stated. And the Jury afd
   with draws and after Some time do againe return to the barr —
   and being called over as also the Plt & Deft but the Deft~ makes -
   default and the Jury all appear and being asked whether they are —
   agreed on a verdict or not do Say they are agreed on a verdict~
   and being asked whether they find for the Plt or Deft~ do Say they
   find for the Plt~ and that they find as to ye first assumption the Deft~
   did assume in manner and forme as above declared & find damages
   Six pounds twelve Shillings Currant money as above declared & Cost of
   Suite as to the Second Assumption they find he did not assume in—
                                                                                                     manner
