August Court 1716 39 detains &ca. and that he have then and there the Said writ &ca —— Att which Said next Court vizt this twenty first day of August the Same year last mentioned the day of return of Saidwrit Came William Frisby Gent~ high Sherf of Said County and made return thereof in these words thereon endorsed - as folls vizt Cepi Corpus pr Wm Ffrisby Sherf —— and a Decln being fild when Said writ Issued and a copy thereof Served therewith according to Act of assembly in Such Case made was as folls viz.t Kt Coty Ss Edward Skinner of Kent County Planter alis Dics Edward Skinner of Kent County in the Province of Maryland Planter was Summoned to Answer unto William Hacket of a plea that he render to him the full &~ just Sum of five hundred pounds of good Sound Merchantable Tobacco — Clear of all manner of Trash in Casque of ye value of Eighty Shillings - Sterling money which he unjustly detains &ca— . And Whereupon ye. afd William by Thomas Bowne his attry Saith that whereas ye afd Edward ye twenty first day of August Anno Domi Seventeen hundred and fourteen at St. Pauls Parish in Kent County afd within ye Jurisdiciõn of this Court~. by his certain bill obligatory which the Sd Edward Sealed with his Seale and as his deed delivered hereunto Court brought the date whereof is the Same day and Year afd bound himself to pay or cause to be paid to the afd William ye afd five hundred pounds of Tobacco qualified as afd in Cask of the afd value of Eighty Shillings Sterling money when thereto required it being for a valuable Consideration before Received Yet the afd Edward the afd . five hundred pounds of Tobacco to the Said William altho’ on the third day of May Anno Domini Seventeen hundred & fifteen & often after at the Parish afd in the County & Jurisdiciõn afd he was thereto required hath not render’d or paid or Caused to be paid but [t]hat to render or pay ye Said — Edward hitherto hath denied & yet den[ie]s & unjustly detains to ye damage of ye Said William one hundred Shillings Sterling money & thereupon he brings Sute &ca- TBowne pr Querr pls &ca. John Doe & Richard Roe And now at this Court came the afd [Plt] by his afd attry & prays the Said Deft may be called who came [an]d the Plt by his Sd Attry prays that he may be Surety for the Sd Plt [for] the Cost if ye Plt Should be cast in the Same which is granted and the af[d] M< r Thomas Bowne comes into Court and Saith that he will pay the Cost in [t]he accõn afd if the Plt Should be non Suited. and Pay it not himself And now the Sd Plt by his Said attry prays. that the Deft~ may give Special bayle to the afd Accõn which is granted and that he be kept in Safe Custody untill he Shall give Special bayle . After which Nathaniel Pearce of this County in Court came and acknow- :ledged himselfe Special bayle [in] the above accon and undertakes ye pa[y] |
