363 March Court 1717 Said next Court vizt. the Eighteenth day of March the Same Year last— mentioned the day of return of Said writ Came Simon Wilmer Gent: high Sherf of Said County and made return thereof in these words thereon~ Endorsed as folls vizt. Cepi Corpus pr Simon Wilmer Sherf . . . And A Decln being fild when Said writ Issued forth and a Copy- thereof Served therewith According to Act of Assembly in Such Case made was as folls vizt. Kent County Ss Richard Fullston of Kent County Cooper alis Dics Richd Fulston of Kent County in ye Province afd. Cooper was Summoned to Answer unto William Frisby of a plea— that he render him the full & just Sume of five Thousand and Sixty — pounds of good Sound Merchantable Leafe Tobacco Clear from all —— manner of Trash in well Seasoned Caske of the value of fifty . pounds Sterling money which from him he unjustly detains &ca. And Whereupon the afd Plt. by Thomas Bowne his attry Saith . that Whereas the afd Deft~. the Twenty Second day of Mary in the Year of our Lord Christ one Thousand Seven hundred and Seventeen at St. Pauls Parish in Kent County within the Jurisdiciõn of this Court by his Certain writing obligatory which he the Said Deft Sealed — with his Seale and as his deed delivered hereinto Court brought^thewhose date^whereofis the Same day and Year afd granted himselfe holden and firmly bound unto the afd Plt~. in the afd full and Just Sume of five Thousand and Sixty pounds of good Sound Merchantable Leafe Tobacco Clear from all manner of Trash in well Seasoned Cask of the afd value of ffifty . pounds Sterling money to be paid unto the afd Plt. when thereunto required Yet the afd Deft~ altho’ often required the afd Sume of~. five Thousand & Sixty pounds of Tobacco to the Said Plt. hath not paid but that to him to render or pay the Said Deft~ hitherto hath denied and Still doth deny and unjustly detain to the damage of— him the Said Plt~. One hundred pounds Sterling money and thereupon he brings Sute &ca . . TBowne pr Querr Pleds : Jno Doe & Richd Roe— And the Sd Deft~. being called came and the Said Plt~ by his afd attry prays that the Said Deft~. might give Special baile to the afd Accõn which was granted On which Edward Scott of Said County Gent~. came into Court and Acknowledged himselfe as Special baile in the above Accõn and doth undertake for the afd Deft the payment of the Debt afd and Cost thereon accruing if in Case the afd Plt Shall obtaine Judgment against the Said Deft in the Said Accõn of Debt and the Said Deft~ the Condemnation afd Shall not— Satisfie nor himselfe to the Custody of the Sherf of Said County deliver |
