   nor made Content~ for the Same but that to pay or Content the Said Deft~
   hitherto hath denied and Still doth denie to the damage of him the Sd
   Plt. Nine hundred pounds of like Tobacco afd and thereupon he brings
   Sute &ca.                 TBowne pr Querr pledges Jno Doe & Richd Roe
   And the afd Deft being Called came And the afd Plt. by his attry afd prayd
   that. the Said Deft might give Special baile to the afd Accõn which
   was granted and that he be kept in Safe Custody by the Sherf of Said County
   untill he Shall give Special bail as afd . . .   After which came into
   Court Samuel Gooding of Said County and here in Court came and Acknow:
   ledged himselfe as Special baile in the afd Accõn and doth undertake for
   the afd Deft~. the payment of the Damages afd And Cost thereon Accruing
   if in case the afd Plt~. Should obtaine Judgment against the Sd Deft in
   the Said Accõn of Trespass of the Case. And the Said Deft~ the Condemna:
  :tion Shall not Satisfie nor himselfe to the Custody of the Sherf of Said County
   deliver or that~ the afd Samuel Gooding the body of the Said Deft~ Shall—
   not render &ca. . . . And the Said Deft~ in his proper person—
   appeared to the above Accõn And Saith that he Cannot gainsay the —
   Accõn afd of him the Said Plt~ nor but that he is Indebted to him the
   Sume of ffour hundred Eighty four pounds of Tobacco and is willing that
   Judgment Should be Entered for the Same and Cost thereon Accruing :
    Therefore it is Considered by the Court here vizt This Twentieth day
   of March Anno Domini One Thousand Seven hundred and Seventeen
   That the afd Plt~. William Frisby do recover against the Said Deft~
   John Cooper as well the afd Sume of ffour hundred Eighty four pounds
   of Tobacco Damages as also the Sume of Three hundred Sixty one pounds
   of Tobacco Cost by the afd Plt~. about his Sute in this behalfe Expended and
   by the Court here of his assent adjudged and the Said Deft~. in mercy

   William Frisby . . | Commanded it was to the Sherf of Kent County .
             at | the Twenty third day of November in the Second Year
   Richard Fulston | of his Lord Ships Dominion &ca. That he take Richard

   County in ye Province afd Cooper if he Should be found in his Bailywick and him
   Safe keep So that he have his body before his Said Lordships Justices of the
   next Court to be held at our Court house in the Town of Chester in Said County [to]
   Answer unto William Frisby of a plea that he render him the full and just~.
   Sume of five Thousand and Sixty pounds of good Sound Merchantable leafe
   Tobacco Clear from all manner of trash in well Seasoned Cask of the value of~
   fifty pounds Sterling money which from him he unjustly detains &ca.
   And that he have then and there the Said Writ~ &ca. . Att which—
