    359                                   March Court 1717
   Goods and Merchandises at the Severall rates and prices in an Accot.
   hereunto annexed Specifically Set forth which in the whole amounts —
   unto the Sume of Six hundred and thirty Seven pounds of Merchantable
   Tobacco upon himselfe assumed and to the Said Plt then and there
   faithfully promised that he the Said Deft~ the afd Sume of Six hundred   .
   and thirty Seven pounds of Merchantable Tobacco unto the
   Said Plt. when thereunto required would well and truly pay and
   Content And that Whereas also the afd Deft~. afterwards vizt the
   afd fourth day of December in the Year afd at the Parish County and
   Jurisdiciõn afd In Consideration that the afd Plt. at the like
   Special Instance and request of the afd Deft~ had then and —
   there last mentioned Sold and delivered unto the afd Deft~.
   and to the proper use and behoofe of the afd Deft~. divers Goods
   and Merchandizes as in the Said Accot. Set forth upon himselfe
   Assumed and to the Said Plt then and there last mentioned —
   faithfully promised that he Said Deft~ So much Merchantable
   Tobacco as the afd last mentioned Goods and Merchandizes —
   Sold and delivered as last Said at the time of the Sale and -
   delivery thereof at Reasonable rates and prices were worth and
   amounted to unto the Said Plt. when thereunto required would
   well and truly pay and Content And the afd Plt~ Indeed Saith
   that the afd last mentioned goods and Merchandizes Sold and —
   delivered as last Said at the time of the Sale and delivery thereof
   at reasonable rates and prices were worth and Amounted unto
   the Sume of Six hundred and thirty Seven pounds of Merchantable
   Tobacco in manner and forme as in the Said Accot~. Set forth
   of which the Said Deft~ then & there last mentioned had Notice
   Nevertheless the afd Deft~ his Severall Promises and assumptions
   afd in form afd made litle minding but fraudulently intending
   him the Said Plt. in that behalfe to deceive and defraud the
   afd Severall Sumes of Tobacco in the whole amounting unto
   the Sume of Twelve hundred and Seventy four pounds of Mer:
 : chantable Tobacco to the Said Plt~ altho’ afterwards vizt. the
   Parish County & Jurisdicion afd was thereunto required hath
   not paid nor made Content for the Same but that to pay or
   Content~ the Said Deft~ hitherto hath denied and Still doth denie to
   the damage of him the Said Plt~ Thirteen hundred pounds of like Tobo
