   353                                   March Court 1717
   the payment of the debt afd and Cost thereon accruing if the Said Plt. Shall
   obtaine Judgment against the Said Deft in the Said Accõn of Debt
   and the Said Deft the Condemnation Shall not Satisfie nor himselfe
   to the Custody of the Sherf of Said County deliver or that the afd Michl.
   Hacket the body of the Said Deft Shall not render &ca.
    And the Said Deft in his proper person appeared to the afd Accõn
   and Saith that he cannot gainsay the Accõn afd of him the Said
   Plt~. nor but that the bill obligatory above mentioned is his
   Act and deed and is willing that Judgment Should be entered for
   the afd Sume of thirteen hundred and forty pounds of Tobacco &
   Cost thereon accruing :   Therefore it is Considered by the
   Court here vizt. this Twentieth day of March Anno Domini
   One Thousand Seven hundred and Seventeen that the afd Plt
   Giles Bond do recover against the Said Deft~ John Sutton as
   well the afd Sume of One Thousand three hundred and forty
   pounds of Tobacco Debt as also the Sume of Three hundred &
   nineteen pounds of Tobacco Cost by the afd Plt about his Sute in
   this behalfe Expended and by the Court here of his assent adjudged
   and the Said Deft~. in mercy

           at | County the Twenty third day of November in
   Nathl Berry | the Second Year of his Lordships Dominion

&ca. that he take Nathaniell Berry of Kent~
   County Planter otherwise called Nathll Berry of Kent County Planter
   if he Should be found in his Bailywick and him Safe keep So that
   he have his body before his Lord Ships Justices of the next Court to
   be held at our Court house in the Town of Chester in Said County to
   Answer unto Giles Bond Mariner of a plea that he render unto him
   the Just Sume of foure hundred and fifty pounds of Clean Every ways
   Merchantable Tobacco in Casque of ye value of four pounds ten —
   Shillings Current Silvr. money of the afd Province of Maryland which
   from him he unjustly detains &ca. And that he have then and there
   the Said writ &ca.    Att which Said next Court vizt the Eighteenth day
   of March the Same Yeare last mentioned the day of return of Said writ
   Came Simon Wilmer Gent~. high Sherf of Said County and made return
   thereof in these words thereon Endorsed as folls vizt Cepi Corpus pr Simon~
   Wilmer Sherf . . And A Decln being fild when Said writ Issued forth and
   a Copy thereof Served therewith According to Act of Assembly in Such
